The incident I am reporting is rather simple and straight to the point. I was terminated from my employer Falcon Express in April of 2009. I was hired in February of 2004 which gave me four plus years of employment at Falcon Express. When new perspective employers contacted Falcon Express concerning my work history, Falcon Express then in turn told the perspective employers they had no knowledge of me ever being employed by Falcon. After obtaining a copy of my DAC report I was also made aware that Falcon Express was not even listed on the report. This information was purposely omitted from my DAC report which made it next to impossible to find new employment seeing as though without Falcon Express being included on my DAC report I now have a 4 plus year gap of employment. Also at the time of termination I was due 4 weeks of vacation pay for which I have never been paid. If there is anyone who could provide assistance with this matter it would be greatly appreciated.

Only a company that is a member of DAC will report on a driver after their employment ended. There is no obligation on an employers part to belong to the organization, or report anything about you, the employee.

A lot of companies will pull your DAC, but not be members of said organization. I have huge "gaps" if you will on my record, but with proper documentation, that should not be an issue. Paycheck stubs, W2's and the like.

You said you were terminated from your employment. I would gather that is the real reason you can't get further employment, rather than not having anything about the job on the DAC.

I would guess you may be getting a less than stellar reference, and it is holding you back.

The matter of money owed is possibly a matter for the wages and hours division of your state, but, as I have found out the hard way, as a truck driver, the only recourse is normally small claims court.
