On July 12, 2012 I return from vacation to open the store I was an assistant manager for them. I get to the store and my key would not unlock the door. The manager lets me in and tells me we need to talk and she has two write up forms on the counter.

The two write up forms were for not securing the funds on June 29, 2012 and the other for using my cellphone. I argue my case with her and the District manager. I denied the allegation for not securing the funds. She told me she had a picture of me not securing the funds and leaving them in the till. She also will try to argue I have done this before. 

The first time I did not secure the funds was in April. Our safe is time delayed and I shut it before realizing I did not put one of the register till bags (what we put register money in at closing) in the safe. So I secured it in the bag inside of the register. This time she says I forgot to even bag up the money from the register. I denied it because forgetting to bag the money is something I have never done. 

I realized after leaving that she claims to taken a picture of what  I did on 6/30/12. I called my DM and told him it was impossible she took the picture because she was out of town on vacation. I asked for the photo and told him I was having an expert look at when the photo was taken. My DM called the store manager and passed on what I said and she changed the dates saying I didn't secure the funds on 6/25/12. I worked in the store all the way to July 1,2012 before taking my vacation and she never once brought it up. When I went to get my write up forms she changed the date from 6/25/12 to 7/1/12. Her story changed three times then she also wrote that I didn't secure the funds when working in another Family Dollar which was also a lie.  They never gave me the photo I asked multiple times.

The write up form that had final discharge on it was for using my cell phone on 7/1/12. I admitted to doing that but I also told her I was on my break smoking a cigarette at the end of the building. I was using my break time to use it only just like every employee does including the store manager. 

I finally realized she made up false allegations against me because I filed a workers compensation claim on 5/25/12. Which they never paid me for the lost time that the doctor made me take off. I read the compensation site and after being lied to by her I realized they was suppose to pay me 70-75% of lost wages due to workers comp claims.

The reason I am concern about this is because I believe she has framed other people to be fired as well. The day I started working their she accused someone of doing fraudulent returns and keeping the money. I talked to the girl about it since I was fired and she still denies doing it. She also tried to fire a black girl with false allegations with the help of one cashier that was involved in getting the black girl and the other girl demoted/fired. I know for a fact this store manager created false evidence against me and there is no telling how many else she did it to.

I am told I will have trouble finding legal help because I am white, but I believe I was discriminated against because I filed a workers comp claim or the fact that I am gay. Either way I worked very hard for this woman. I did my job, her job, and the cashiers job to prove I was a hard worker. If I can get some kind of help that would be great. I believe this woman should pay for what she has done. It is not right for someone of higher power to frame another to get them fired. I am sure I am not the only one to experience this and I won't be the last but I want to help stop at least one person before she ruins other peoples lives.

Allow me to help. This is why you were fired. I likely would have fired you after the incident in april, forgetting to put the money in the safe is a big deal. Also, what is your company's cell phone policy? If they don't want you even talking on it on breaks, then you were violating it. It doesnt matter what everyone else is doing.

As for the workman's comp, you will likely need to hire a lawyer to help you get those funds. You are correct that this incident likely fueled their desire to fire you. In most states an employer can terminate you for any reason except for certain federally protected reasons. They couldn't fire you for claiming workman's comp, but they can fire you for whatever else they would like to fire you for. You will have trouble getting legal help in this situation, you admit to not securing funds in the past. You admit to using your cell phone. As for being discriminated against for being gay, in most states this is still legal. Unless alabama is one of the states that has added no discrimination agains sexual orientation, it is fully legal to fire someone for being gay.
