In August of 2015 My wife, myself and our four children went to a time-share review at Atlantic Palace. We were at the sales table for about 7 hours. The Head Sales Person informed us that this process did not require a credit check. Also if we fall behind on payments it would be a very long time before they forclose if they do at all. During the sales process they offered the time share at several prices, which we were not budging as we just couldn't afford them.

After each offer was denied, the initial sales person would go get another person to speak to us and keep us in our seats saying we were walking away from an incredible investment, they offered us food and were very pleasent. They finally offered the time share to us for a monthly payment that I thought we could afford. We paid the closing costs and signed our papers. After a week I called the head sales person to state we have to back-out as we just cant afford the payment. He said we are passed the recision period and you will have to pay your obligations. I stated we can't afford it, what are my alternatives. He said if you don't pay it they will forclose and ruin your credit, which was very different stance than what he had with us at the signing table.

So we started to make our monthly payments. I called to make reservations for us in January of 2016. I was then informed that we had to pay the 2015 & 2016 maintenance fees before we could use the facility. This was yet another bill of over $600 that we just could not afford. They did offer us an alternative to each years maintenance fees if we would give them the name of 3 individuals for each year of fees that they could speak to. As you can imagine I was not willing to put anyone I knew in front of these people. I would not want my name tied to that association at all.

At this point we decided that if we can't use the facility, and we are struggling to make the payments, then why are we paying anything. When we stopped making payments Atlantic Palace had accepted $2,000 of our money with nothing in return. As owners we were never able to use the property, nor were any solutions provided to us to do so. It's not like we had keys that we could use to go into our supposed owned property. We still needed there permission and assistance to get into the time share. 

This is when the collection calls and emails started. Some of the people were very pleasent, and one was just down right mob like with his threats. Now they are threatening to foreclose on the property, sue us for the money we have to pay them including all fees. Yet we never took possesion of anything. 

This is the most recent email! Notice it states Mortgage Owner. That's right we own a mortgage not a property.

                 PRE-FORECLOSURE NOTICE OF DEFAULT

             This is a time sensitive matter and there is no reason to avoid us if we are willing to work with you.  Unless we hear from you immediately, we will proceed as indicated.
