On a recent Saturday morning, before 8 a.m., on my cell phone (we do not have a land line), I received a call from this Frances Lopez claiming to be a litigator in a lawsuit against me for failure to payback a payday loan from Fast Cash National.

He could barely speak English so I had a hard time understanding him. He was very demanding wanting $1036.15 settlement. I told him I didn't know what he was talking about. I had not received any communication from this company in any form....email (which is how I did all my payday loans), phone, or USPS mail. You could tell he didn't believe me. But he knew ALL my info that I have to put in the applications.

I finally offered to settle right then and there. Well, he'd have to contact the creditor. So I held on for a bit and soon he returned. Good news, he said, they would accept 70% then. I told him I'd pay it in full. He said I had to fax immediately a letter of apology to him and then he told me what to write in it.

I gave them my debit/credit card info, but they soon called back. It wouldn't go thru for that amount. I tried to contact my bank as they are open till noon on Saturday (it was 11 a.m.), but got a recording that they were closed. They gentleman that called me about the declined transaction had said he would give me 25 minutes and would call back.

I didn't get another phone call till about 2 p.m. and it was from the litigator guy. I explained that the bank was closed when I tried to call them. He had a different attitude by now. He understood that. He gave me an entirely different number to call him first thing on Monday after I had made arrangements with my bank to release the funds.

Over the weekend, I made a spreadsheet of all my payday loans, amounts, and auto payback withdrawals for more than 2 years. Fast Cash National does not appear anywhere. I didn't get funds from them. I think they were the website that contacted lenders after you put your info in the system.

It is now late Monday evening and I've heard nothing from him & I didn't call him. If he contacts me again, I'm going to demand proof of deposit of the funds. My spreadsheet shows that I paid back way more than was borrowed on all my payday loans. Payday loans mean just that. Payback is automatically deducted from your account that you gave the information on.

Also, on Saturday when he wanted the letter of apology faxed to him, I asked him what time he had. We were on the same time. The phone number he gave me to call on Monday was listed as a California phone number.

I have NEVER had any problems with any of my other payday lenders. I have never, ever dealt with this company.

Has anyone else had any problem like this?

Please say you didn't give him any personal information. This is a very common scam. Where they usually threaten you that you are about to be sued or arrested. These "scare" tactitics are illegal in the US. The problem is that these people are most likely in a foreign country. As you have figured out you never took a loan from this company. If they call back let them know you will be contacting the police and reporting them. After they give you a few "choice" words they will probably hang up and never call again.

In the mean time contact the fraud department of your bank ASAP. Explain the situation letting them know that your Debit Card number may have been comprimised and you need it cancelled and a new number issued. This should keep them from taking anything out of your account. Just remember you will have to update any other legitimate companies you have your old debit card number with for things such as Auto-Pays.
