This agency continues to call after I told them three times that I live alone, the person they're looking for desn't reside at my number, and I have no collectible debts because all my debt was discharged and I have no credit. They claim to have taken my number off their call list, but they continue to call.

First of all, in collections there is NO SUCH THING as a "cease and desist" letter. The exact verbage from the FDCPA is CEASE COMMUNICATIONS.

Second, there is no requirement to send it by REGISTERED mail. CERTIFED MAIL / RETURN RECIEPT REQUESTED should be used.

Mrsa..Do you even know what REGISTERED mail is?? Registered Mail is used for high value and/or irreplaceable items. The item is never left unattended and is in a lockbox the entire time. It is also very expensive.

And now to clear up what you can sue them for. You can sue for UP TO $1000 in punitive damages plus court costs and legal fees. Then you can also sue for actual losses on the civil side. That's it.

I found this wonderful website online which assists you in compiling your own legal Cease & Desist form . In this form you are to list your name and any of your phone numbers being contacted by the company. This is a LEGAL document. This letter instructs the company to end all contact with the persons and numbers listed. You have to send this letter registered mail. Once received (they have to sign for it), if they contact you past that date they have violated federal law (see Public Law 95-109 Section 805-807). Keep copies of these phone records! If violated you have legal grounds to sue them for all their worth, the list starts with harassment. I sent this letter to the CEO (John Neary Sr.) and never got another call.
