Fedex Ground Driver delivers to anyone who will sign... Company doesn't care... real recipient works for Fedex Memphis Tennessee

My wife order a lap top computer for our son [who lives in Memphis, we live near Nashville] from Circuit city who in turn hired Fedex to deliver. As my son was waiting in his apartment the driver says he delivered to someone who signed for it. Circuit city says its fedex's fault, fedex says it a Circuit city problem. Meanwhile we are out 800 dollars. Here is the funny part, my son works for Fedex air. The company refuses to look into the matter any further. The police say it is a civil matter and the credit card company says, 'well they got a signature...not my son's mind you

First of all, I'd never order a thing through Circuit City, much less buy it in one of their stores. They are the number one complained about electronics retailer in the nation.

Personally, I don't care a bit more for Fed-Ex because I had a personal experience with one of their drivers being involved in a scheme to steal my identity, and Fed-Ex refused to act upon it, even after I had gathered all the evidence for them.

All this aside, what you need to do immediately is to file a WRITTEN dispute with the credit card company over this transaction. None of these three will do a thing until this issue is forced upon them through a legal dispute process.

You ordered merchandise. It never arrived at where it was supposed to arrive.

By Federal law, you have the right to dispute transactions for merchandise that was never delivered to you, or to the authorized recipient, to whom it was supposed to be delivered to.

After you have submitted your complaint, the credit card company is required by law to conduct an investigation. They should be able to inform you of their findings within ninety days or two billing cycles, whichever date comes first. In most cases, merchants will back off rather than risk losing the privilege of accepting credit cards. The credit card company will then cancel the charges as well as all corresponding interest.

Circuit City had the responsibility to see to it that the AUTHORIZED recipient received the computer. THEY hired Fed-Ex Ground, not you. They are the party that should be looking into this, and they will, as soon as the credit card company informs them that the transaction is being disputed and that unless they can prove that the merchandise was indeed delivered to your son, the money you paid to them will be credited to your card account, and charged back to them if Circuit City doesn't cough up a computer.

Here's a sample letter you need to draw up and send to the credit card company:

Dear Credit Card Co.:

My name is Vinnie -----. My account number is ----------. I am
disputing a charge on the bill you mailed to me on ----------. That bill
includes a charge in the amount of $800.00 to Circuit City. I am formerly filing a complaint and wish to dispute this charge due to the fact that the merchandise purchased was never received by the authorized recipient.

On (date), I purchased a computer locally from a Circuit City in Nashville, Tennessee for my son, who lives in Memphis, Tennessee. Circuit City agreed to ship the purchased computer to his residence in Memphis. They apparently contracted Fed-Ex Ground to deliver it. My son never received the computer, and inquiries made to trace the shipment, resulted in Fed-Ex claiming it had been delivered and was signed for on (date). Circuit City claims they have a "valid" signature as well. To whom they actually delivered it to, I cannot determine, but it was absolutely not delivered to my son. The signature they have is not that of my son, and what they have is no doubt a forged signature in the name of my son.

I have attempted to resolve this issue through both Circuit City and Fed-Ex Ground, and to date, neither is willing to assist me in any manner. I am therefore forced to place the entire transaction into dispute, because the merchandise paid for by credit card was not received, and thus is now a default on the part of the merchant to produce what was purchased.

Please investigate this dispute at your earliest convenience, and I am requesting you to provide to me with a written statement of the outcome of your investigation as soon as it is concluded.

Thank you for your time and attention to this matter.

Here is a thought. Ask FedEX for a copy of the signature card or the name of the person who signed for it. Then track down that person and comfront him or her and threaten to sue. Contact the local consummer affiars person at the main TV station there and see if they can help you. IF Fedex will not give you teh information, sue them for it.
