This company sent out a repo guy to pick up our 2 vehicles. They never told us they were going to do this. Husband had just lost his job. So we call Fifth Third to make arrangements to make partial payments on our account. They told us you can make partial payments but, not guaranteed that you will be OK. We explained that did not have a job anymore, was let go do to cut backs in the company. We did not know what to do. In the meantime our 2 vehicles are gone they sold them and said if we wanted them back we could get them back if we paid a large amount of money, which we did not have. So 2 years went by and no call from Fifth Third, then all of suddenly we get a letter from the court saying that we are being taken to court by Autovest LLC representing Fifth Third on the vehicles that we no longer have anymore. We ended up going to court making small payments that we could. Then we got a point where we had nothing coming in and could not make any payments. Then we did not here from the company for 2-3 years then we get another court paper. We find out that they froze all of our accounts including our kids savings accounts which we have nothing to do with. Which they took this money out of the accounts. Then when we finally got a job part time they starting garnishing our wages. Then finally we had to eventually quit our jobs because we did not have enough left over to be able to pay utilities, etc. And we still had all 6 kids in school. Now 2 years later has went by no calls on this. Then we get a letter from a company (Servicing Solutions, LLC) out of Southfield, Michigan saying they represent Autovest, LLC. Assignee of Fifth Third Bank. The letter stated that for the nxt 3 months whatever we pd to them will be like we pd 2 payments each time. So, we figured it was a OK company. Then after making 3 payments a lady called us from Servicing Solutions and said that they could not accept our payment, because, if was not enough, they wanted over $500 a month but, they would take the payment we made off of our bal.
Now that months have gone by.

Today 12-15-08 we come home with a filed paper from the court in our door, which, our son found in the door. This is now from Autovest LLC. saying about my husband required to appear before the court to answer to nonexempt property subject to execution, attachment or garnishment. We don't any property we rent. And they sent a letter to our employer, which we finally got full time jobs after 7 years. It says that ordered to appear in court to answer ? concerning property which we rent on 2-9-09. We don't understand how they can do this when it has set so long and our credit report states that this account is charged off. What do we do? We really can't afford a lawyer. Does anyone have any suggestions for us.

They will ask you under oath about your assets. That's all. I would talk to a local bankruptcy attorney if you are unable to pay your regular expenses and have the garnishment as well.
