FILENE'S sold me watch and didn't refund my money Boston Massachusetts

There was a 40 % discount in Filene's. This store will be closed. I thought the reason of the discount is this. Last Friday, on 14th of April 2006, I bought a watch from there. I asked the salesgirl if she can make narrower the watch, but she told me she can't, also told me that you can go to any jewelery store and they can make it narrower for you.

After that I went to a jewelery store and they narrowed it. When I went home looked my watch carefully and saw that there are lots of scares on it and on the belt of the watch. On Saturday I went Filene's and showed the scares on my watch, the salasewoman told me that since our manager is not hear you should come Monday. I didn't went there on Monday because it was national holiday for M.A State. Then I went Filene's on Tuesday spoke to another salesman and he told me the same thing since our manager is not hear you should come anothetday, but he gave me their manager's work hourse.

At the end I went there today 20th of April 2006 and showed the scares on my watch. They told me it is the reason why they make discount. I told them, if I know this issue I would't buy it, anybody didn't tell me this. They showed me the writting that is on the shalves which says "almost perfect". However I am not a native speaker, I am a froigner and it's my 4th week in USA. I am here for improving my english skills. I tryed to explained that how can I understan what does it mean. After lots of talking they decided to change my watch but the othet one that they offered me was not better than mine.

I refused to change it, I told I don't want this watch I want my money back. They refused me and showed me the receipt, there is a stamp on the receipt which says "All sales final no returns on trade ins". However they stamped my receipt after I payed or after they get the money. Untill I got the receipt, there is no opportunity to know that they don't accept returns. What is more they told me this watch is made norower. May be these scares happened in there, but it has lots of scares and scares are not near the narrowed part, they are in the different parts.

The other thing they told me was you should be seen the sacers on the wach when you tried it. However, because it is not so clean, there is dust on it, I couldn't see, and also they are not so deep, if you doesn't look carefully you couldn't see anything.

It seems to me that it is an unfair stuation. My english is not good enough to andrestand the meaning of "almost perfect", moreover how can I know the reason for discount is not because they are closing and try to finish everything in that store.

In this point I would like to learn that if there is something that I can do to get my money back.
If anyone can help me I would be so pleased.

Thank you in advance.

I agree with the other comment on this report. Just about nywhere you go once a product has been modified (in your case narrowed) it cannot be returned. Second of all if the shelf actually said "almost perfect" then right there it tells you that merchandise does have small (usually appearance) defects.

The fact that your english wasn't good can't really be an excuse because then what, anywhere that has a return policy someone can say oh well I can't read english so it doesn't apply to me? It doesn't work like that.

I work the customer service desk at a large store and if a sign to a product says a lower price than the customer was charged then we actually honor the product for free. Same if a product is sold "as is" its not dependant on whether or not the consumer can read english as that would be discrimination to the people that actually live in American and speak english.

National holiday?

Patriot's day is only a state holiday in Massachusetts. Why did that prevent you from going to the store on Monday as suggested, unless the store is located in Boston and then I can see the reason for waiting until Tuesday.

Unfortunately, once the watch was modified, there is probably no chance of returning it (which would be the case with most anything that was modified after purchase). As with anything you purchase, you really should look it over carefully before handing over your money. The seller has no idea if you saw the scarrs and decided to buy it anyway or if you just had buyer's remorse and are using the scarrs as an excuse to return it.

Is it possible to have the jeweler who made it narrower buff out or touch up the areas that are scarred? Depending on the value of the watch, it may or may not be worth it.

Good luck.
