We purchased a new home from Findley Homes in March of this year. We noticed some water problems in the walk through that they said they would fix. A week later there was a big storm and we had water coming in our house in three locations.

We called the builder(Findley) and they came out the next day. They said that they would make the necessary repairs. They failed to do so. We lived in the home for 5 months, and they kept scheduling appointments to fix the problems and would either cancel at the last minute or not show up.

Finally we got them to come out once again. In a nut shell, the meeting was a failure, and it resulted in the Findley's agreeing to buy back the home. The next day we recieved a contract for them to buy it back. We agreed on a price, closing date and everything. We were scheduled to close on August 18th. They backed out two days before saying they couldn't come up with the money, but in the offer there was no financing contingency because it was a certified funds offer.

So they are in breech of contract. We moved out of them home and into an apartment so that we could give it back, but now that they didn't close we are having to make two house payments. Also, we started a new build job and the new builder agreed to take the down payment once we closed with the Findley's and got our deposit back from our old house. Now we are unable to pay because we never closed. The Findley's are not working with us at all on this and something needs to be done.

Have you contacted the Johnson County Contractors Licensing Board? They can be found on the Internet. Check with them and find out how to file a complaint. Have all of your paperwork especially regarding the repairs that were never made. You may have to copy and fax it to them.
This is the website address:

http://contractorlicensing.jocogov.org/

You should also request their Contractor's insurance information. If the Contractor won't provide it, get it from the licensing board.

Good luck.
