I have been harassed by Fingerhut since 1998 I ordered a product from this company I can't even remember what the hell it was, to make a long story short I never received the item. When they first started calling me in 1998 I informed them that I never received the product the rep on the phone stated that they would track the package to whatever address it went to. Since I never received the item I was not interested in ordering anything else from them. They called my home everyday Harassing me and my daughter when she answered the phone she was 11 at the time, how rude of them! So I'm now receiving Collection letters telling me to pay almost $400.00 and I know whatever it was I ordered those many years ago would not even be close to this Ridiculous price. I'm seeking an attorney through Legal Aid to assist me regarding this issue for the harassment and damaging my credit report. I can truly say that this is the worst company I've ever encountered!

I too ran into this problem that you have posted (read my statement below). I suggest that you reply ONLY via certified return receipt requested letters to everyone now and demand that Fingerhut and the collection agency show proof that the delivery was accepted by you. This would come via a U.S. Postal Certified Receipt of Delivery or UPS or FedEx Proof of Delivery statement. To which they would not be able to prove since they don't normally request that when they ship anything. They have to prove that the delivery was made to ensure the debt valid. Without proof of delivery they have a truly hard time to prove that you received the item(s) that you requested.

Now demand proof to be given to you within a certain amount of days. I used 15 business days from time of mailing and then stated in the letter that failure to reply within the requested time warrents that the debt is not valid and that they also agree to remove any statements on any credit report and to notify any collection agents that the debt is not valid also. Now chances are you will never hear from them but if you do they will send you a letter stating that they need more time (usually 60 days) to investigate this matter further to which I agree by sending another certified return receipt requested letter agreeing to the date (spell that date out!!!) Then on the 61 day or whatever that date is fire off a letter and be dominate now telling them that the date has passed and no proof of deliver was shown and they MUST delete the debt via credit reports and cancel any debt collection efforts.

If you like also and this helped me - contact your State Dept of Consumer Affairs (Wisconsin is part of the Dept of Agriculture) and tell them via a complaint letter what is going on. Here in Wisconsin I submitted the complaint with all the documentation I did to them at the same time. They stepped in the middle and did the work for me by contacting them and demanding proof of the debt. The spelled out a time period to which to this day they never did reply to. Funny how they went realllllly quite when I got the state involved.

If you need help let me know and I will do more research for you in the State of Illinois but DONT HIRE A LAWYER. Hell save the money and do it yourself!!! Just remember to save a copy of all letters you send, all letters MUST be mailed certified, return receipt required and spell out a FIRM time line for them to respond to you on all letters (otherwise they will d**k around forever)
