First American Investment Co., LLC As Assignee Of Providian Financial Corp., And Relin. Et Al Esqs. Consumer debt issue trying to avoid judgment; up against attys who bait and switch. Rochester New York
I have an old debt with Providian ($4,000 aged more than 5 years since last payment). Last year their agent, Capital Management offered me a settlement of $2,000. I did not have the money, but later took it out of my 401 account to pay. By that time Relin et al were representing Providian who had assigned the debt to First American, and threatened to sue me for $7,000. I have attempted to negotiate settlement with them (Relin, Goldstein, & Crane, LLP) (sending check they refused). They advised me that their "client" (First American) would accept $5,560 . I agreed to pay off the $5,560 at $150/mo x 36 mos. and Relin, et all now state "their client" will not accept. First American will not talk to me directly because their attorneys are involved. They have an office (1 worker) who answers the phone once weekly.
I have offered to pay based on advice (credit counselor) and information (from paralegal at Relin) that payment arrangements could be made. I will continue to offer options and update as progress occurs.
