My husband and I closed on our property on Aug.21,2002, we received a check for $1409.00 at closing. We were were happy because we had deplenished our savings buying our home and paying closing cost. A week after closing we received a notice from our bank stating that the check had bounced.

We phoned the company to see what the problem could be and they stated that there was some sort of error and we were only supposed to get $100.00 at closing (some difference Huh?) We chalked it up to human error and made an appointment to pick up our "correct check". My husband went to pick up the check the next day and was informed that in order for us to receive the money owed to us we had to go to our bank and get their bounced check , return it to them and then and only then could we receive our money; So in other words help us cover our butts while we hold your money and you get screwed double with bounced check fees.

Yes you have to bring back the return check. That would be proof that you First American talked to you and made you aware of the miscalculation. You give them back the incorrect check and accept the corrected amount. Otherwise, you could try to recover for the incorrect check, knowing full well, you discussed and accepted the new check.

If the roles were reversed, you would want the incorrect check back also to know the transaction was corrected and completed.
