I am writing this letter on behalf of my mother in-law who is 86 years old and lives by herself in Forest Hills Queens, NY. On 10/29/08 she hired First Choice Roofing alias FIRST CHOICE HANDYMAN ROOFING & WATERPROOFING 105-04 Jamaica Ave, Box 9 Richmond Hill, NY 11418 to do a simple skylight repair on her flat roof. She paid the owner Theodore W. Kirchner $425.00 Cash for a (1) year guarantee


 


On 10/2/09 She called them to come back because the skylight was leaking again. When the owner Theodore W, Kirchner from- FIRST CHOICE HANDYMAN ROOFING & WATERPROOFING arrived at her home he told her that the skylight was leaking from another spot and it would cost an additional $450.00. My mother in-law told Ted it was in the same spot as before, she didnt want to argue because she has high blood pressure so she paid cash again to repair the skylight which was still under guarantee from the first repair. Within (1) week of the 2nd repair the skylight leaked again. My mother in-law spoke to Ted Kirchner on the phone and he told her that he would send his man over the following day to do the repairs. My mother in-law told Ted to please call before coming by because she wouldnt be home the whole day. Well she was home the whole day and nobody from FIRST CHOICE HANDYMAN ROOFING & WATERPROOFING showed up, Theodore W. Kirchner never called until the following morning; he lied to my mother in-law and said the repairs were done; she said okay and let it go.  My wife then tried to call Theodore W. Kirchner and (her daughter) left messages on his Work # 703-835-5551 and Cell # 718-496-7008 with no return calls. My wife called me in Virginia where I live and explained the whole situation to me.


 


I called Theodore W. Kirchner and told him that Im a roof repair trouble shooter with over 37 years experience. I told him to please get the repair done as quickly as possible because of her health.  I told him if you dont have your crew there by tomorrow 10/28/09 Ill get another roofer to her house on Saturday 10-31-09 because of heavy rain in the forecast for Saturday evening. He said okay. I told him if I do this youll be responsible for the bill, he replied well see.


 


Saturday 10/31/09 I hired a roofer who I personally trained 15 years ago to do the needed repairs for $500.00. My roofer called me when he was on the roof and explained there were no repairs done of any kind for several months. Ted Kirchner told me he used flashing cement and a fiberglass membrane to repair the roof in several areas. This is a Lie. Reason: When ever you use flashing cement it takes a few months to fully harden. All the cement that was used on repairs were rock solid! If he had done the repairs on 10/2/09 the cement would have been soft. He billed her $450.00 for NO Work Performed!


 


If your wondering why originally I didn't do the repairs myself it's because she    never told me the roof was leaking.  After I hired my roofer to do the work she had a bad storm with heavy rain. Finally she has peace of mind with no leaks!

You charged my mother inlaw twice for the same job to repair a simple skylight leak. I have all her receipts. I have telephone call records from the phone company that shows all the calls I made to you without any return calls made to me. I have close up photos of the skylight and the roof above which shows ABSOLUTELY NO WORK! This is my specialty! You can B.S your customers! You can't do that to me! If your going to continue lying I'll set up a link that will be directed to a page that will show her receipts, telephone transactions and close up photos of the roof so that everyone else can see. Its your call. I'm in the process calling Small Claims Court, Attorney General's Office, Better Business Bureau and posting this article on several directories.

My mother inlaw paid you $425.00 and $450.00 Cash. Not to mention I paid $500.00 to finally have the repairs done correctly. We are requesting $1,375.00 for all the money spent. If this goes to court we'll hold you responsible for the cost of the interior damage as well.

I would like to start this rebuttal and explain that this complaint is completly wrong and a lie. I have a full written contract signed and was verbally agreed on. I also have all receipts and pictures of all my repairs. This is simple case of a customer not wanting to spend money on property that is not his and wanting a repair against what a contractor told him. He told me he was a contractor and understands the condition of the roof from prior repairs that he as had. He requested A REPAIR ONLY and to do the best I could do. The customers son in law explained he was a contractor in the past and understands the risk of a repair with a roof in this poor condition. This repair was not charged twice. This was two completely different jobs one year and two months apart. The customer called for the second job because the first one worked well. When the second job worked only seventy five percent the son in law called me. he said that he understood the repair may not work completly knowing the condition of the roof. He asked me to go back and see what I could do and also give him a price on a new roof. I went back and did some more repairs with pictures and called him and gave him my price on a new roof which he said was a very good price and would consider it . I also told him if the job is done in the near future I would also drop the complete cost of the second repair with fifty percent more of a warrenty than any one else would give him. It is completly unfair that anyone can put and will be allowed to put false information to damage someones reputation because they use their own judgement to try to save money against the advise of a professional contractor, and be spiteful enough to try to damage somebodys reputation when they should have taken there advise at first. Again I have all contracts and pictures to verify my truth.
