On 01.27.06 the Veterans Administration mistakenly transfered $1,214.95 into an account with First Citizens Bank in Camp Lejeune, NC. This account was closed by me approximetly 10 years ago. (1996).

On or about 02.10.06 I telephoned First Citizens Bank customer service department to resolve this mistake. I was told the money was deposited into an account at the Camp LeJeune branch and that I needed to contact the Branch directly.

I telephoned the Branch and spoke to the Branc manager (Terri Cummings). I was informed by ms. Cummings that the money was deposited into my old account and that the bank removed $13.93. I apparently had an outstanding check when I closed the account. Fair enough!

She then told me that the bank mailed the remaing balance to a North Carolina address where I no longer live. I live in Hawaii. I informed herthat the money needed to be returned to the VA before any future payments were made to me. She said the bank would NOT do that. I notified my attorney and a letter was sent to Ms. Cummings and she blatently ignored the letter.

I have filed a complaint with the North Carolina Attorney General (Useless). I have also filed complaints with the Comptroller of the Currency and the FDIC. Ms. Cummings and the bank ignore everything sent to them by these agencies.

To date I have yet to recieve my money that they feel is theirs and how can it go into an account that was closed 10 years ago?!!

I am currently preparing a lawsuit against Ms. Cummings and First Citizens Bank. What she and the Bank fail to understand is that I don't care about the cost of the suit. I care that people and the bank need to know that they can not do this to people.

Most importantly, it is not a Bank's responsibility to inform other businesses of your change of address and/or your account no longer being open. In fact, it's against the law for them to disclose any information about your personal accounts due to the privacy act. Secondly, the Bank is not your personal mail service nor are they bounty hunters. It is known that a Bank will use your last known address they have on file to send anything that is rightfully yours. It's a customers responsibility to change any direct deposits they have going into an account they no longer use to either A. a new account you are using or B. Request a paper check. And of course... update them with your new mailing address. Who knew!? No doubt, its unfortunate that you didn't get the money that was rightfully yours in a timely fashion, however, it's your wrong. Fact is, you didn't notify the VA the account they had on file was no longer open, the bank ended up with a sum of money that can't go into a closed account, so they were nice enough to cut a check and attempted to send it to you. A very pricey mistake and waste of time, but definitely only yours.

The VA's famous for screwing up. That said, Cummings is just a drone. If you want anything done, you'll have to go higher up the food chain. I'm surprised your attorney hasn't done that. I'd be looking for a new attorney. The bank could probably care less about your $1,214. Here's a suggestion. Call the CG of Camp Lejeune and request to speak with him. Someone will talk with you. CG's hate screwing with piddling crap like this. He has better things to do with his time, like run a base BUT, the bank's on his station/post/camp and he has some control over it. Bring up your Congressmen. That'll piss 'em off. They hate "congits". Congressional Inquires and Investigations. By the way, where's the money? Did the check get cashed, destroyed, deposited? I doubt the bank is ignoring the Comp/Currency or the FDIC. There's more to this then meets the eye.
