Our small firm hired this company to handle payroll filings and payments. The company withdrew withholdings from our account yet failed to file or pay any taxes on our behalf.  I didn't find out about this until we were 3  quarters behind. Total amount stolen was in excess of $12k.  It is unbelievable to me that something like this could have happened.

I'm hoping that someone may have information that could help us recuperate our money lost.  Does anyone know if the State requires a payroll company such as this to post some sort of bond?  There must be something out there to protect consumers from a company that has in it's power to withdraw and hold money on behalf on others.  

Any information that would be greatly appreciated.

Hi, I can only assume by now that you have realized you are not alone. First Priority Pay took millions, yes millions of dollars from companies for tax purposes and never sent the money to the IRS. The company declared business bankruptcy and Jerry Carter filed for personal bankruptcy. This will drag on for years. there seems to be $500,000.00 in an account that will be used to pay back these companies after all legal fees have been paid. In short, Maybe you'll get pennies on the dollar in a couple of years. If you make arrangements with the IRS to pay your now over due taxes they will probably remove the penalty charges. That seems to be what is happening with everyone. We lost about 25K and frankly we're just moving on with our lives. We're paying it back over two years. Some companies actually lost more than 250K and went under. There is just no good news here, sorry. By the way, I actually spoke with an investigator with the IRS in Person, supplied him with all the paperwork to investigate and still nothing can be done. They actually agreed with me on what happened but nothing ever came of it. About twenty to thirty companies got together hired a lawyer paid money to start a lawsuit and after months the lawyer actually returned most of the money because he was honest and knew there was nothing he could do for his clients. If you can afford it, take it from me, just pay the IRS and move on. The whole thing stinks and everyone I have spoken with is the same boat, we've tried EVERYTHING but there is just no way to get the money back and The IRS must get paid. That's there position! Sorry.

P.S. If your wondering the attorney General in at least three states PA NJ (the other escapes me) have been notified as well as the FBI.
