Hi, I'm the disfavored spouse in a break-up situation.  FSB claims to have sent mailings, mortgage and checking account, to me for a year at the house address.  BUT I had gotten a PO Box for mail
security reasons during this period.  FSB had refused to change the address to this box stating my name was not first on the mortgage.  FSB claimed that the estranged was paying the mortgage, since, after all they claim, it was his.  It is a joint mortgage.  The Florence/Easthampton post office has been very anal in returning my mail to its sender, claiming I have moved, if the street address is used rather than the PO Box number.  At this time, I had no reason to disbelieve FSB in their claim that the mortgage was being paid by my spouse.

So what happened was my estranged screwed around with the mortgage. which up until then was in perfect standing, being previously paid by me, until it looked like this.  3 times 30 days late, 2 times 60 days late, 1 time 90 days late.  Needless to say, the mortgage goes into foreclosure, 10/2008.  The foreclosure notice I did receive at the street address via certified mail.  Apparently, the post office does deliver some certified mail even when it is not correctly addressed.

After catching my breath, I go in to FSB and pay thousands of dollars to restore the mortgage to
good standing.  When I once again ask FSB to please mail the banking statements to me at my PO Box, Ms Williams refuses.  The mortgage was to continue to be mailed to my estranged spouse, the guy who intentionally caused a near foreclosure.  So from this point on, I walk into the FSB bank each month, without any payment slip as a reminder, and pay the mortgage in full, on time.  I'm not totally stupid, my spouse obviously wasn't paying on the mortgage.  Fast forward to August
2010.

A friend suggests I take advantage of the free credit reports once a year program.  I go on
line and do so.  Guess what?  All those defaults from the estrange spouse's escapades are on my credit report.  We still aren't divorced yet.  I gather all my payment receipts, the past foreclosure papers, etc.   For about a week I put together a letter to the Banking Commissioner of
the State of Massachusetts,  using my Experian credit report as a fact sheet.  What happens?  

The Banking Commissioner, Mr. Saul Rivas, accepts FSB's claim stating in his letter, "due to an administrative error, you were not notified when the mailing address for this mortgage account was changed by the co-borrower", (let's not use his name, Saul!) and FSB will remove these defaults
from my credit reports.  FSB, Ms Cheryl Scully, says it was an "administrative inadvertence" and
they will remove the defaults from my credit reports.  The FSB letter was dated September 13, 2010. Fast forward to today, May 2012.

I did that free credit report gig again.  My TransUnion credit report shows these same defaults from the estranged and FSB, "Date Updated: 09/09/2010".  I did pay Experian for another credit report back in 2010 to check to make sure FSB followed through with their removing my spouse's defaults. In fact, I paid Experian for over a year, just to monitor my credit report.  But I never anticipated that FSB would behave in such a deceitful manner as to hit my TransUnion report days before fooling
me into believing their "administrative inadvertence" would be corrected.  I have strong reason to believe that only my credit reports were hit, not his.  But we'll have to wait for the divorce trail to have the hard evidence.

"Big Banks Behaving Badly"...well, FSB is the largest mortgage lender in Hampshire
county.  "Get even"  - ----  -  that's exactly what my estranged spouse says to me!!!

What is FSB apologizing for?  Their FALSE reporting in August 2009 that our mortgage was "90 days past due for Oct 2008"?  I responded immediately upon being informed by FSB that there were problems with the mortgage.  On Oct 30, 2008, all past payments, where the delinquencies notices were sent to my mother-in-law, the Oct 2008 mortgage payment, and the Nov 2008 mortgage payment, were ALL paid by me, in-person, to Ms Williams.  I have the bank teller's time stamped receipt.

In August 2009, FSB posted on Experian 7 delinquencies, the "90 days past due for Oct 2008" is not the only FALSE post.  After asking Saul Rivas for help, ALL delinquencies from Experian were removed and the pay-off date of Sept 2010 added.  [I got the mortgage away from FSB].  BUT this FALSE post of "90 days past due for Oct 2008" was posted on TransUnion's report.  This I did not discover until 2012.

June 2012 I initiated the online dispute process with TransUnion.  Now this is how FSB has resolved the matter.

The Experian report has 7 delinquent posts, again, but not exactly the same 7 that FSB used back in Aug 2009.  In addition, the closing date has been pushed ahead to June 2012.  So what does Experian do with all those months from Sept 2010 [when the mortgage was closed out with FSB] up to June 2012?  Experian fills in "ND"'s, no data!  The TransUnion and Equifax also have 7 delinquencies posted.

Bottom line, FSB maliciously harmed my credit history.  There is no resolve to this matter; FSB and Saul Rivas have made it very clear that they can behave as they choose.  I am not spending another moment of my life checking credit reports or being deceived by FSB.  After 4 years of trying to manage in this corrupt financial atmosphere, I resolve to try to empower others by sharing my experience.
