Knowing that Florida is a table funding state, Peggy Burt the owner and operator of this title company closed a loan on a purchase, then sent the wire back to the lenders because the lenders were mad at the seller holding a second mortgage.  This caused alot of stress that was unnecessary, the closing happened a week later, causing distress and a back log with being able to get the subcontractors in there to finish the house.

I am very disappointed in Peggy, yes I owe her my closing check bounced, however if she had not returned the lenders' wire and stopped payment on the seller's proceeds then my check would have never bounced.

Dishonest Customer Got Caught

The customer who filed this report does not have her facts straight in that
1)  The funds were NEVER wired back to the lender;
2)  She was dishonest in that she never disclosed to the lender that she was giving a second mortgage to the seller;
3)  She knew the checking account she wrote the check to this company on had been closed by her son.

As a closing agent I am a third disinterested party to a transaction whose job is to pass clear and marketable title to the buyer while following all instructions given by the buyer, seller and lender.  When ANY of these instructions conflict it is my responsibility to stop the closing and inform all parties.

When it was disclosed to the first mortgage lender that the buyer was giving a second mortgage to the seller, therefore not investing any of her own cash in to the property, I have given written instruction to hold their funds and not disburse until the situation had been resolved.   This was all explained to the person who filed this report but she refused to believe that the lender had the right to stop disbursement and the buyer (person filing the report) tried to bully and lie her way in to getting me to disburse funds in direct conflict with the lender instruction. 

The buyer then notes in her report that my actions held up the contractors getting in to the house to make repairs.  I heard from the lender when the loan came due 60 days later.  They state that no work was ever done on this house by anyone nor had the buyer made the payment that had come due.  They were, therefore, taking the house.

This customer has a history of purchasing houses in the Lee County, Florida area and then losing them to the private lenders she has convinced to lend her money.  She also has a history of writing bad checks which I found out about the hard way.  Luckily it was only a little under $300.00 and I could afford to cover that much of a lose.

I have done business in Lee County for 32 years and have a very good reputation for being honest, professional and knowledgable in this business, unlike the buyer who filed this report.  I can provide a list of attorney's, realtors and lenders to anyone who is interested who will tell you that I do not do business in any manner but that of a professional, honest business person.
