Complaint Review: Ford Motor Credit Company

Ford Motor Credit Company Purchased Ford 2002 in 10/02; purchased disabiity ins.; disability Ins. procrastinated in paying claims; Acct. Was informede by Ford in 12/05, loan was written off. On 10/1/07 truck was repossed by WAP Recovery. Received no communication from Ford. Need legal advise as I was not properly treated by Ins. and notified by Ford via mail or phone. My phone # has not changed since 2005. HELP! Atlanta Region- Atlanta Georgia

In October of 2002, I purchsed a 2002 Ford Explorer XLT from Lou Sabh Ford of Decatur, GA ; 1665 Scott Blvd.(404) 633-4005. I purchased the GAP Ins., Disability Ins., and an extended warrenty. In June of 2005, I became disabled.I filed insurance claim American National Insurance Co., P.O. Box 9007- League City, TX 77574-9007 where I dealt with Annie Rodriguez. My Claim No., A085433/Policy # 00X0555704 took forever to process because Insurance asked questions after questions. Ford Credit was in communication with me and Ms. Rodriiquez practically daily. Ford Credit was informed by Ins. Company that a payment would be submitted in December 2005. Payment was made to Ford however, Ford Credit decided to write the account off on December 10, 2005. I was told that I could continue sending payments however, this account was written off and appear on my credit history as such. It did. I did not continue filing my disability claims because I was informed that truck hade been writtn off.

I did not receive anymore communication from Ford. On Thursday of this week, I received the shocker of a life time. Upon discovering my truck missing from parking lot (Gated Community), I contacted the San Leandro, CA Police Department and was informed the truck had indeed been repossed. I called Ford Motor Credit and was told they had no informaion of my deliquency because the debt had been written off in 12/2005. I later learned the truck was picked up by WAP National Auto Recovery of Sacramento. I was told my mail wasw being mailed to my old address however, I made a change of address once I moved. They (Ford) have/had access to my phone number as it is the same number they used in 12/05. 510-332-9551. This is a very ugly method of stealing my truck from under my noise. I am disabled for the remainded of lfie. I am a senior citizen who lives on a fixed income. I RECEIVED VERY NEATIVE FEEDBACK FROM DISBILITY YET, payments for this insurance is included in my balance. Please advise me as to how I may proceed from here. URGENT PLEASE.... Thanks

By reading the op I would say there is nothing you can do. Ford appears to have done what they had to.
You posted the reason for repo in your report.

You discontinued the disability payments and did not make any payments from there on. You lost the truck due to non-payment, your fault.
Had you continued with the disability paperwork you would still have a truck.

I have disability Insurance on my truck also, as you know the insurance is through another company and yes I know all about the forms and monthly forms the doctor must fill out and sign but when I filed mine Ford wanted to work with me and even skipped a payment so the insurance company could have time to process's the claim and start the payment for disability.

Im not saying Ford did not wont your truck but hell they told me they did not want to repo my truck and would work with me plus you get letters in the mail and phone calls I know trust me my dad died and they did all that before they even came and got his Ford truck. The only thing that I can see is that the insurance company waited to long to file the forms or they denied you the disability insurance which is not unusual you have to appeal but it takes more than one month and one missed truck payment to get your truck reposed. And when the appeal is made in your decision they have to pay the back payment amount from date it was denied.

You Owed them Money

So you knew you owed them money knew that the vehicle was your collateral and never paid them? When any company says that your loan was written off it simply means they have charged off your account. It does not mean you do not owe them the money. Did you ask them if the rest of the vehicle was free? of course not you knew you owed them. "Charging Off" an account doesn't amount to alot to the consumer besides your debt fell past due. companies do it for accounting rules but the debt is still there. As far a no calls I'd say that none are required in state. As far as you being left high & dry without a vehicle that you needed ummmm..do you really need someone to say again you should have taken care of this long before?
