Fortuna advertised this used item as "tested" & "product works fine". I bid in good faith and paid in good faith. Payment was made on 11/3/05. Fortuna rewarded my good faith actions by sending me a worthless item. The item arrived via USPS. They violated ebay seller requirements by misrepresenting the item. Email contact was made to complain and I had to then contact them by phone for a return authorization. The item was returned on 11/21/05 and a replacement promised. No replacement came. My requests for a refund were steadfastly denied. I have neither my money nor the item.

They wanted to hold me to the bid as being a legal and binding obligation on my part but they ignored the fact that they obtained my money by falsely advertising the item. I feel that this act of deception does not allow them to bind me to the bid or any of their policies. The smooth running of ebay depends on the honesty of both the buyer and the seller. This is a dishonest seller who should not be allowed on ebay.

I attempted to use the ebay dispute resolution route to bring this matter to a close. Fortuna stonewalled and stalled by continuously asking for unnecessary information. Apparently they knew that if they stalled long enough the dispute would time out. This use of the dispute process is contrary to its purpose. If the company is not operating in good faith, no dispute process will bring about a satisfactory conclusion to a defrauded customer. In order to emphasize the failure of the dispute process I closed the ebay dispute with another explanation of how they took my money and gave me nothing in return.

For all I know, they are selling and reselling this worthless item over and over again to collect the shipping and handling charges.

Stay away from this company!!!

Ralph,

First, we would like to extend our deepest apologies for your negative experience with purchasing from us. As we move forward with branching out our business into other forms of e-commerce, we are finding, more than ever, that customer satisfaction is truly an aspect of our business which we cannot afford to ignore.

I'm unable to find specific information to link to your issue and formally confirm your complaint, however, I can certainly agree with you that it is TOTALLY possible that you have had a negative experience with us.

During the time period when you posted this message, I was working as a regular customer service representative. As such, I can tell you, from the inside, that the department was not managed well!! There were certain employees who worked here that did not take their jobs seriously, and have ultimately caused us to lose an unknown number of customers. This was wrong, and we do sincerely apologize for your dissatisfaction and your terrible experience

It should go without saying that those people are no longer employed here, and I don't intend to ever let our customer service fall behind again. I personally stand behind every transaction we complete and I WILL guarantee your satisfaction for all of your past (and future?) transactions.

I know that ripoffreport.com doesn't want us to ask you to have to contact us again, and believe me, I can understand why. But the problem here is, this transaction is so old, that we can't find any of your information. If, by any chance you can just give me your RMA # from the return? Just so that I have something research and go off of; so that I can resolve this once and for all.

I'll do all the research, all I need is that tiny little 4 digit RMA number to help you.

I truly wish to prove to you that Fortuna Enterprises values your satisfaction as a past, and hopefully re-gained customer.
