Complaint Review: Fredericki McGuire

I had an accident approximately 2 years ago before I could get home and settle down I had a knock on my door.  It was Rick McGuire's lynch man ambulance chaser!  I have never had this happen to me before!  He heard all about my accident, knew where my truck was towed, he had all the details and a signed contract by Rick McGuire! He as a fast talker and informed me of things that were not true in front of witnesses.  

Rick McGuire charges 45% attorney fee vs 33% of the usual fees.  I asked about this amount and he informed me that the 45% is an additional fee that they charge the person or their insurance company.  This amount is not subtracted from my total amount that I will receive.  He stated that I will have to pay the hospital bills but no attorney fees from my amount.

Liar!  

I would speak to many people in the office but Genie was a rude country A___! She was a smoker with this raspy voice and rude as He__!  She doesn't know how to speak with customers.  

When the disbursement statement was sent to me, the actually received 60% of the total cost.  Now, you tell me how did that happen?  They received over 26,000 and I received 13,000.  Their money was taken from my portion of the lawsuit.  Oops, I thought that this wasn't going to happen!

When the check was mailed to their office, I received a letter from the other company notifying me when they mailed that check to their office.  They tried to hide it, but I had confirmation that they received it.  It took over 3 months for me to receive my 13,000!  I was told the Rick was out of town and that they didn't know when he will return!  Well, they kept collecting interest on my money and I never received any of it. 

Then I was asked if I wanted all of the attorney fees taken out at once because there was another part.  If I agreed to this then the other check will totally go  to me.  Well, that is a lie!  Out of 5,000,they only wanted to give me 2637.14.  I refused to sign and they agreed upon 3250.00.  Once I received the disbursement statement after they sat on my check for over a month! it was only 2637.14!

I am attaching the disbursal statement you signed and the contract you signed. As I explained, I think you are misremembering what Genie was talking about before you signed the disbursal statement. There were expenses associated with the liability claim and then there were expenses associated with the PIP claim. You were given the option to take all of the expenses out of the first disbursal, including all expenses associated with the PIP claim even though that claim was not resolved at that time. We could not possibly have taken out all of the attorney’s fees in the first disbursal. You can see on the disbursal statement that attorney’s fees of 35% were taken out of the PIP proceeds that had been received up to that point. We did not know how much more we were going to get on the PIP claim at that point, so it was impossible to calculate how much more the fee was going to be. It had to wait until we actually had a settlement. Under the contract, you still owe attorney’s fees on the settlement amount of $5,000 that we got after the disbursal statement was signed.

Previously I told you that we did incur another expense after the disbursal was signed but we are waiving that. Also, I previously indicated that 45% was due on the $5,000. This ws correct under the contract. However, because we reduced the attorney’s fees on the PIP claim from 45% to 35% in the previous disbursal, we will reduce the attorney’s fees due on the additional $5,000 from 45% to 35%. This would be $3,250 net to you.

Now, they went back on their lies and trying to reduce it! I have the agreement in writing!.  I was told the RICK MCGUIRE will not accept this that his office offered, and he will not meet with me or speak with me!  He is my attorney and I have never spoken with him nor seen him!  I have NEVER DONE any business like this!

RIP OFF/AMBULANCE CHASER, INTEREST COLLECTING OFFICE!
