According to the FTC, Versatile Marketing Solutions (VMS), under the guidance of its owner, Jasjit Gotra, called millions of consumers whose names and phone numbers VMS bought from lead generators. The lead generators claimed that those consumers had given VMS permission to contact them about the installation of a free home security system, but in reality, they had not. In its complaint, the FTC alleges that the defendants’ tactics violated the Commission’s Telemarketing Sales Rule.

 They are still doing it, I acted like I wanted the product after like the 50th phone call, no exageration at least 50 phone calls despite being on the Do Not Call List.

I got a call back from 561 666 3990 and unlike the never ending harrassing phone calls from all different numbers they use with that call ID trickery when I am at work and have to put down my tools to get the phone, that 561 number you can call back. 

That number lead to "Alliance Security"  the same telphone system and menu that picks up when you call the number on the website.

You are seriously misinformed as to what your company is doing.

Every call I have received from Alliance has been identified as "Alliance Security". They are representing YOU, and that makes YOU (Alliance) ultimately responsible. This is why the FTC sued Alliance in 2014. Did you even read the PDF the complainent linked in his report? Your company broke the law then, and is still in violation of the terms of the settlement agreement, as well as the federal TCPA & TSR.

This is the complaint from the filing.

Calls to Persons Registered on the National Do Not Call Registry 44. In numerous instances, in connection with telemarketing, Defendants have initiated or caused others to initiate an outbound telephone call to a person’s telephone number on the National Do Not Call Registry in violation of the TSR. 16 C.F.R. § 310.4(b)(1)(iii)(B).

Count II
Ignoring Entity-Specific Do Not Call Requests 45. In numerous instances, in connection with telemarketing, Defendants have initiated or caused others to initiate an outbound telephone call to a person who has previously stated that he or she does not wish to receive such a call made by or on behalf of the seller whose goods or services are being offered in violation of the TSR. 16 C.F.R. § 310.4(b)(1)(iii)(A).

I underlined the relevent part, "or caused others". This covers the "lots of working relationships with all kinds of sales groups around the Nation that we install for but have no control over" part in your rebuttal. If they are selling for you, you (Alliance) are ultimately responsible for their continued, and flagrant, violation of the numbers on the DNC list, the federal TCPA & TSR. 

Granted the complainant was foolish to agree to an installation after numerous unwanted calls, because by doing so he established a business relationship with you, which allows you to call to set up installation time(s). Since the TCPA & TSR allow an aggrieved consumer to sue (small claims for TCPA, federal district for TSR), he should have gone that route (many don't because it requires a bit of effort on their part; ie, obtaining phone records, saving automated messages, saving conversation dialogue, etc). He only did that after around 50 (according to him) unwanted sales calls  soliciting him to purchase the monitoring system when agreeing to installation of the free system.

"And FYI you need to add your number on all the DNC registries once a year to be up to date"

Ummm... no. That is absolutely incorrect for the federal DNC.

"When You Might Need to Register Again

How long does my phone number stay registered?

Telephone numbers on the Registry don’t expire. We only remove your number when it’s disconnected and reassigned, unless you ask us to remove it."

Your bosses are irritating hundres of throusands of consumers who are registered to the DNC, consumers who have pressed "1" on the automated system to have their names removed from your calling list, consumers who verbally told the sales caller they were not interested. Yet the calls continue non-stop. I have been saving & printing out records of every call in my call log, recording the automated message each one gives, and recording the phone # provided in the automated message, identifying the business calling me. I am doing so because I fully intend to excercise my rights as outlined in the TCPA & TSR. I don't think my printer has ever been so busy, I had to refill my black ink cartridge twice. I have a stack of phone record printouts. Printed out the FTC lawsuit & settlement terms (I want the lawyer acting on my behalf to be aware of this). Printed out the TCPA document & the TSR section involving my sirtuation, highlighting all relevant sections.

What a consumer can do if TCPA is violated:

(3) PRIVATE RIGHT OF ACTION.—A person or entity may, if otherwise permitted by the laws or rules of court of a State, bring in an appropriate court of that State—

(A) an action based on a violation of this subsection or the regulations prescribed under this subsection to enjoin such violation,

(B) an action to recover for actual monetary loss from such a violation, or to receive $500 in damages for each such violation, whichever is greater, or

(C) both such actions. If the court finds that the defendant willfully or knowingly violated this subsection or the regulations prescribed under this subsection, the court may, in its discretion, increase the amount of the award to an amount equal to not more than 3 times the amount available under subparagraph (B) of this paragraph.

What a consumer do if the TSR is violated:

Penalties for Violating the Rule

Anyone who violates the TSR is subject to civil penalties of up to $40,000 for each violation. In addition, violators may be subject to nationwide injunctions that prohibit certain conduct, and may be required to pay redress to injured consumers.

I am in the process of gathering information, I plan on retaining a lawyer for further action, because despite opting out of further calls by using the automated removal system, and verbally asking to have all calls stop, I have continued to receive unwanted calls from sales people calling on behalf of Alliance Security, offering a free system & installation with a monthly monitoring plan agreement.

 Alliance called you after you decided or deceived the callers blowing up your phone trying to sell you a system correct? OK follow me We "Alliance" only call after you agree to the system to confirm everything 2-3 times before we roll a truck to your home. We are a installation & monitoring company we have lots of working relationships with all kinds of sales groups around the Nation that we install for but have no control over how many times or when these sales people call you. Please don't knock Alliance before you do some research into the sales group that's actually breaking the do not call order.. And FYI you need to add your number on all the DNC registries once a year to be up to date. I will apologize for Alliance as I am a Loyal Employee & run the state of Alabama daily meeting wonderful people & fully protecting their homes. We are just trying to confirm information & Apt. time if we are calling you. I will be happy explain any questions anyone has about how this all works to the best of my ability.
