FRY'S ELECTRONICS Sold me non-working item, but won't refund my money! Product was DOA! They ripped me off! Fountain Valley California

ATTENTION: FRY'S HAS DEFRAUDED ME--DON'T BE THE NEXT ON THEIR LIST!

Fry's sold me a non-working product (a "World of Warcraft" video game), and they refuse to refund me my hard-earned money! I bought the product, opened it, tried to use it, and it NEVER WORKED! It said the product key is already in use! In other words, the product was dead to me on arrival!

The returns desk told me they won't accept the game because it had been opened. Well, THE ONLY WAY I COULD EVER FIND OUT IF THE GAME WORKS OR NOT IS TO OPEN IT AND TRY IT! So, I opened it, and it didn't work!

Legally, based on the Implied Warranty of Merchantability, Fry's has a legal obligation to return my money; however, they are refusing to do it! I don't even care what their policy is; the fact is that the law is the law! They sold me a garbage product and are keeping my money! They told me to contact the manufacturer; however, I have been alive long enough to know better than to go down that long and winding road.

In the end, they owe me my money back, and I will not settle this dispute for less. I have already filed a Better Business Bureau complaint.

Let this be a warning to anyone who might even think about shopping at FRY'S: IF THEY DON'T MIND TRYING TO RIP ME OFF FOR A MERE $20, DON'T TAKE A CHANCE BUYING ANYTHING MORE EXPENSIVE FROM THEM!! THEY JUST MIGHT TRY TO RIP YOU OFF, TOO!

Tony, Tony, Tony. Fry's has no legal obligation to refund you at all. Because of copyright law no retailer is allowed to accept opened software (games), music, or movies for a refund. Period. What is interesting about your story is that you purchased the game because you wanted it, correct? Took it home and found that it did not work. Correct? Took it back to the store for a refund... this is where you're caught...not an exchange. Correct? Because, you see, they did offer an exchange, didn't they? Come on, fess up, you'll feel better telling the whole story. They can offer an exchange for the exact same title so you would've gotten a new game and gone home and enjoyed yourself. But, alas, that was not your plan, was it? No it wasn't. Your plan was to purchase the game, go home and burn it to your computer, and then return the game as "defective" for a full refund. Sorry, heard this same story 3 to the ninth power times. Not buying it. But you did! Bwaaahhahahah!
