long story short: put waterbed on layaway sept. 2002, delivered november 2002, leak discovered after use twice. Promised service 2 X no show. Agreed to fair value exchange. picked comparably priced furniture, confirmed with sales person, at literal last minute as service was knocking on my door for the purpose of removing damaged furniture to make room for exchange, salesperson phoned and said no deal. they will repair but not remove and replace as agreed.

No deal, lousy service is what caused the problem, the bed was improperly put together causing the damage. could plainly see bed assembled against manuafacturers direction.

Reported to Better Business bureau, State Attorney General, Futurerest ignored both agencies. Went to court, judge ruled in my favor, and Futurerest has also ignored the court order to pay back money.....Order was August of 2003 it is now January 2004. No money returned as ordered by court.

The court did order repayment and the sheriff is coming to get my money, you are having a sherriff sale dear, I am making a $200 deposit with the sheriff to secure my court ordered refund of the money, so if you were not notified you best check with the bucks county court house because they are coming for my the money.... I also happen to know a former employee who told me that the way you treated us is a regular practice for you.......the furniture was installed incorrectly I made arrangements with the salesperson on the phone spoke with her and my two ADULT sons at the same time to secure this arrrangement ,so yes the replacement was approved by your establishment your employee your company, and you continue to lie. Your service caused the problem, and you just aren't paying because I told you in court I would rather sleep on dirt than do any type of business with you again. shame on you lying thieving ripoff con.

"Bait & Switch" or Not allowing to "Switch & Abate"

Fran purchased a waterbed from Future Rest and reported a problem a week or two after delivery. Days before the service call was to be performed, Fran's son visited our showroom in the Neshaminy Mall. At that time he picked out some different furniture that "he liked better". Nothing was solidified. He was not accompanied by either of his parents (he is a minor) nor did he have any paperwork concerning the purchase. He lacked the capacity to change the order under the circumstances.

Upon arrival to repair or replace any defective items, we were informed we would not be given the opportunity to do so. If we were not going to replace the alleged defective merchandise with a totally different group of items, we would have to leave. I say alleged defective because the state of the merchandise was not as such when it was delivered, it had been altered.

Future Rest acted in good faith by attempting to warranty any items necessary, but were not given that chance. Reference to manufacturer's directions not being followed is incorrect. More recent manufacturer's directions were produced in court to contradict such claims. As for the "Judge's ruling", we have yet to be notified of any such ruling by the court. The Pennsylvania small claims court do not give a ruling at the end of the trial. Instead the judge says he will review the case and send each party an answer. We have yet to receive any notification from the court either by regular mail, certified mail, telephone, e-mail or otherwise.

As for the title of the report, what fraudulent, deceptive business practices were performed? Fran received exactly what she purchased. Nothing more nothing less. There was no bait & switch. She did not answer an ad for one item only to be slyly switched to a different one. Nothing of the sort occurred. A case of buyers remorse may be the answer.

Not permitting Fran's underage son to "switch and abate" the original purchase is our only wrong doing. Without a parental signature of approval, I'd veto it, wouldn't you?
