Complaint Review: G & J Pepsi

G&J PEPSI Will not approve my back surgery I have a cracked disc I've fighting with them since 1998, it's crippling me. ripoff Columbus Ohio

In 1998 I was employed by G&J Pepsi in Columbus Ohio. I was injured while at one of th stores I was assigned to merchandise. All I ever ask for is to have my back fixed and go back to work.

While I was off work I happen to catch the tail end of the news. Pepsi had been sued for throwing minorities applications away. A year after that I received a check in the mail from that settlement in which I had no knowledge I was included in it. It came with a short letter that they settled but do not admit to any wrong doing.

I'm 47 and I need this cracked disc removed. There are many days I can barely get up or walk. I have many sleepless nights because of the pain. They send you to these doctors who will say there's nothing wrong when they have the x-rays and mri's right in front of them. I've been sent to doctors that didn't even bother to look at my films. They sit there and tell you one thing but when they write up their reports nothing they have told you are in their report. I wonder how much their paid to lie for the company, But yet an still they want to settle. If it was all about money I would of took it an ran but it's not and God knows there were times when

I didn't know how I was going to pay my rent, but food etc. Why would they want to settle instead of approving my surgery? Why are they making me suffer? If I could of afforded to pay for it myself I would of. Anybody have any answers for me?

I did go to the hospital everything was reported and I was taken off work. In order to go back the doctor put restrictions on what I could and could not do. Of course they wouldn't accomadate me I was told they didn't have light duty.

I also had an attorney in which I had to find another because he wasn't I would say didn't have enough confidence or just didn't want to handle the case. I finally found another, but it's been appeal after appeal.

In fact i got papers today for a hearing to see if I can get approved for the surgery I need. The only things were ever approved were the minor things like nerve blocks when I say minor I mean the operation I needed would never be approved so the doctor has tried to keep me has comfortable as he could.

Wish me luck aand keep me in your prayers. I hope this will be the final hearing and in hope that it's ruled in my favor.

I too have damaged disks so I feel your pain, literally. However, why would you wait this long to do something? I wouldn't have waited 6 days, much less 6 years.

As soon as you were injured you should have gone to the hospital and reported it as an on the job injury. You can go anywhere you choose for your initial emergency treatment.

I would have immediately went out and found a workmans comp lawyer to get the ball rolling.

You can still do it, but the case will be much more difficult now. You ARE entitled to be compensated for an on the job injury and subsequent disability.

As soon as you were injured you should have gone to the hospital and reported it as an on the job injury. You can go anywhere you choose for your initial emergency treatment.

I would have immediately went out and found a workmans comp lawyer to get the ball rolling.

You can still do it, but the case will be much more difficult now. You ARE entitled to be compensated for an on the job injury and subsequent disability.

The Settlement Had Nothing to Do with your Back

Yvonne, the settlement check you got had nothing to do with your workers comp injury. You should have spent that money as you saw fit. You need to contact the company's HR department to find out who handles their workers compensation programs, get a telephone # and address, and contact those people for assistance in getting your back fixed. If you have no luck, contact the Ohio State Department of Workers Compensation...look in the blue pages of the phone book or google it online. Ask for help from them. Good luck!
