I was searching for an Apple Iphone 16gb with acessories. I saw ebay item no - 170224068306 matching my requirements on Ebay.com. I bid on the same item but unfortunately was not able make up the highest bid. I was the second highest. I received a mesg on my email address (registered with ebay.com) mentioning me a second chance offer. I thought it might be because the first bidder might have not able to make payment and so I got second chance offer. I replied the seller Gabrial Saurez (ebay userid) to contact me if he can sell the same item at $400. He sent me a mesg from his cell no. 214-236-3274 on my cingular phone (((ROR redacted))) informing me that he is ready for the deal. I inquired thru sms about the item condition and other stuff. He said the item is in good condition and not even used and he is ready to send me the item at $400 (including shipping). he also asked me directly send payment to his paypal account and then he will send me the invoice. I was shocked at this. I agreed upon buying it as I was about to get invoice. The next day I waited for the invoice. He meanwhile cancelled his item listing from Ebay. He sent me the invoice next day evening (which was from paypal). I requested him the Ebay Invoice so that I can be secured thru Ebay and as I was going to make the Payment thru Paypal, i will be secured thru paypal too. He responded that as you agreed to buy the item I cancelled the item listing from ebay.com and also the last bid price was $492 which was higher than our agreed amount so even if I generate the invoice from ebay, it would be of $492 and not $400. I asked him to send me a paypal invoice. He sent me a money request/invoice of paypal to my account (registered email with Paypal) mentioning the ebay item no. in there. As I thought I was secured thru Paypal, I sent him the money amounting to $400 from my paypal account. The transaction id for the same is - 7AR639463P559344T. As I sent him the payment, I acknowledge him on his cell no. that his payment has been credited in his account. He responded that he will ship the item the next day itself. He also mentioned that he will give me the shipment tracking no. I waited for his call the next day and he didnt called me up. I called him the day after asking for the shipment tracking no. he said he had already shipped it thru United Postal Service but as he is at office he is not able to give me the tracking no. this time he used other cell no. 469-834-5421 to call me. I waited 2 more days for his call. In the meantime, after receiving the payment, he also cancelled the money request on paypal. I tried to contact him again and again but he never responded and then I started getting the mesg The no. you have called is not reachable on both of his cell nos. (old one and the new one as mentioned above) I created a dispute with paypal and even they kept on waiting for the response from the seller. Finally paypal informed me that they are not able to recover my $400 from bigdaddy75208@yahoo.com as Gabrial Saurez. Paypal closed my dispute and I was nowhere to go any further. Paypal promises its customers that they are secured when transaction is done thru Paypal. What the Hell ! These Paypal guyz are mother f***ers. The site which cannot even recognize a valid user or account/membership on their website, how can they bluddy make such false promises. Any user can go in and f*** up paypal by creating false id/usernames. they will continue doing their frauds and paypal customers are helpless...I thought to file a sue against the seller but even that will take away most of my time to make followup again and again. Finally I got this site to file my complaint. I trust it and so writing to you. My cell no is (((ROR redacted))). you can contact me at anytime regarding this complaint on my cell. Also I have all the document proofs on my email, paypal account for the communication with seller alongwith all the sms mesgs from his cell phones. As I think that I am cheated and he made a fraud with me, I would always hope that Gabrial Saurez (bigdaddy75208@yahoo.com on ebay and paypal) does not do this with others. So would hope to give him the best punishment and penalty so that person like Gabrial never repeats such mistakes. All the above incidents happened between 29th May, 2008 and 20th June. Even we can get a detailed description of each communication from my emails and also paypal transactions. All the above facts are true and complete to the best of my knowledge and I would submit the proofs for the same as and when required.

First of all if you make a purchase from an ebay seller off ebay meaning they canceled the item you are not covered. Second there is programs where he can contact you and make any phone number appear that he wants to not giving away his actual phone number, hence you couldn't reach him when you contacted him back. Third as soon as you paid he sent the money to his account, stayed in touch with you until it hit the bank then cut off all communication because paypal can't legally touch his bank account once it is there. You should have known this was a scam when he argreed to a price of $400 and the bidding was at $492. Who in their right mind would do that. That should of been a big hint. Oh well learn from your mistakes.
