This man has changed the name of his production company so many times and owes so many people money, beware he can seem nice to your face one minute, names of his production co. in the last year are Gunclub Road Produtions, Fall City Productions

Thank you for your thoughtful and intelligent remarks. Please understand that I had to remark on the absolutely stupid remarks made by Linda, although she seems to support your position. We welcome owners, like your self, to comment on the site.

I will first state that we are not sponsored by the Better Business Bureau or connected in any way, and we are absolutely opposed to that sham enterprise. It is anti-consumer, pro-business to the extent that information to Rip-off Report tells us; they are known to engage in possible fraud and racketeering.

Next, we do, where and when possible contact those reported on the sight. Often we have old contact information or the individual who receives the information drops the ball. Likewise, we will inform the complainant of your comments and if the person chooses not to respond it will say much about his complaint.

In many cases, it turns out that there is only a miscommunication or misunderstanding between parties and we have successfully negotiated resolution. The value that we bring is that the process is open where the public can decide, and not hidden so that, in many cases, more people are able to be ripped off.

In conclusion, we would like to say that we do have one independent concern about this company. The following statement appears on the Fall City Productions website:

"Despite the threats of actor's strikes last year, the Appalachian States Kentucky, Tennessee and West Virginia came away from the impending strikes virtually unscathed."

We take umbrage to the sentiment as it appears to be anti-Screen Actor's Guild (SAG). This site fully supports that union and suggest that you change your tune.

First off I am shocked that the BBB would sponsor a sight such as this where people can make accusation and no notice is sent to the person or persons being accused.



Second. I've known Gary for many years now and have been around for the company name changes-as was the person I believe to have written the accusation. I, like them have been an investor, in these some of these companies. In the time that I have known Gary only one project went bad, and that was the fault of another company.



People need to understand that from the day you start raising money for a project to the day it hits the street can be upwards of two years.



Lastly, the name changes were the desires of the investors in the companies. Old investors were always given the opportunity to "roll over" into the new company. And, by the way, Small film companies generally change their name with every film.

I assume that you are not an attorney. If you are, you're not a very good one. Let me enlighten you.



First of all, you will be amazed at the number of complaints that are bona fide rip-offs. We level the playing field. Companies and people who intentionally rip off others hide behind what I call the litigation jungle. They want to pull you in and your complaint may disappear all together along with your resolve.



In most cases, one of the conditions of any settlement is total silence about the transaction... why do you suppose that is? So they can continue using the same modus operandi to rip off others.



Second, why are you concerned? Do you have a stake in this matter, or do you know someone else who has been reported? Most people who report here are disgruntled. They are disgruntled with the system which is another rip off that just gives them the run around, wasting more of their time and money. Quite often they do understand and have been lied to, and are just trying to straighten things out.



As to your final disingenuous "concern" for this website. I would point out that since it is written in the website, it could not be slander, but libel. Learn to know the difference! Another big hint: if there would be legal action, truth is the perfect defense. That puts the person who brings the suit into the position of proving that these statements are not true. The burden becomes that of the Plaintiff.



Also, since you have not identified your connection to this report, other than disinterested third party, you have no right to request anything about this report. Oh, and another thing, if you knew anything about the current case law on the subject, we can not be named in the suit. So until such time as you deem it necessary to make your next move, you can Kiss my @$$,



As for as the validity of the complaints filed by consumers, Rip-off Reports are almost always accurate and reliable. In fact, I was in the offices of TV Producers for 48 Hours about 4 months ago. One particular producer was in a nearby room, and on the (intercom) phone with another TV Producer from ABC's Good Morning America. verifying slanderous reports

I have concerns about a web site where negative claims can be made against people without their knowledge. It appears that there is no accountability for those making the claims.



I have reason to believe that the people who have 'reported' this "rip off" are disgruntled people that did not understand their part of the agreement that they made with Mr. Kirk.



I would recommend that this report be removed from the site because it appears to be slanderous and could constitiute a legal action against the web site owners and the creators of this report.
