Complaint Review: Gary's Pool and Patio

I had just bought a new house in Corpus Christi Texas and wanted to put a pool in the backyard.  I contacted Gary's Pools and Patio for an estimate.  The salesman, Jonathan Tutt showed up and said the back yard would handle a good size pool.  In fact he already had one in stock that he was willing to discount.

Jonathan Tutt quoted a price of $28845 and said a $1000 deposit was needed to get things started.  I signed the contract January 8th, 2013 and gave him a check for a thousand dollars.  I was assured a pool could be installed and ready to go within 6 weeks.  The check was cashed the next day.

However a problem surfaced when a gas line was discovered going across the middle of the back yard.  The fiberglass pool that had been selected was now too big to go in the back yard with the gas line in it's present location.  I was told a smaller pool could go in, but at the same price.  I felt this was a bait and switch and declined.  I asked if they could move the line.  They said no they don't do that.  I then requested my money back.  This was the end of January.

After numerous emails, phone calls and posts to Gary's Pool and Patio I have yet to receive my refund of a thousand dollars.  It is now the end of March.

Taking somebody's money and not providing the product at the agreed upon price is more than a rip off... it is theft.
