This hole thing started when my oldest daughter Meagan Newcomb bought a pickup on 3/10/03 from Gates Chevy World in Mishawka . Before that I had went with her to a couple other dealers and was pricing trucks but they were all to much for her to afford. I was trying to explain to her that she needed to pay off her car and look for a cheaper truck that she could afford. Meagan is very bad with money she owes everybody and we can't get it to sink in that she needs to start paying off her bills.

We went to Oliver Ford in Plymouth and found her a nice truck but even with me as a co-signer she still had to have thirty five hundred dollars down. That is when she called Gates and they told her over the phone to come and see them and they would sell her a truck without a co-signer so that night she came home with a truck.

On or around 3/20/03 they called her and told her she had to have a co-signer for her loan or she had to give the truck back.. Her mother and I were on vacation at the time so Gates told her that her nineteen year old sister Holly Newcomb could co sign.

Mr. Oliver at that time told them Holly would only have to be a co-signer for six month then Meagan wouldn't need a co-signer anymore. At one of my meetings with Mr. Oliver I ask him what was this and how it works. He explained they do it all the time that in six month Meagan would establish her credit then she could get a new loan without a co-signer. I never hear of something as stupid as that so I called GMAC and they told me he was lying to us.

Mr. Oliver gave Holly some papers to sign and told her that she was co-signing for Meagan's truck. Before they left that day Meagan and Holly ran into the salesman that sold Meagan her truck. They started talking and Holly told him that she liked that yellow S10 pickup that was in there lot. She went in and co-signed for her sister on 3/25/03 and also drove home in a new truck.

Gates wanted to sell her a truck so bad that they took her car in as trade site unseen. The thing is Holly maybe brings home $300.00 a month, has a $350.00 truck payment and co-signer on her sisters truck. Her mother and I got back home on 3/29/03 and couldn't believe what had happened an how Gates could push something like this threw. I called Dave Henderson the next day 3/30/03 witch in no time transferred me to Lance Oliver the finance manager.

I was mad at my girls and Gates and wanted to find out what happened. I told Lance Oliver I had the title to the car that they took on trade because it was in Holly and my wives name and not going to sign off and wanted the deal voided at that time. That same night I went to Gates found Dave Henderson and he sent me to Lance Oliver. Mr. Oliver at that time Holly had good credit so she qualified for a co-signer and also to buy another truck.

I still didn't understand how the banks let this go threw. I got hold of Rick Meewes b/ he called wanting the title for the trade, they had sold it and needed to get the title to who had bought it. I didn't know you could sell a car with out a title. But at the same time he told me when a person as good credit sometime they will extend what they loan a person even if it is more that she makes. I told him the deal that Lance Oliver had made me and he said he would look into it. So I called the bank that gave her the loan, had Holly get all the paper work that Gates have given them since the only paper work Gates gave the girls was a copy of the contract.

What I found out is Gate's had lied on Holly's loan application, she works at Ally Opps as a waitress, makes two something an hour plus tips, just started working there three weeks prier to that and has been living at our house for nineteen years.The application states she works at Ally Inc, as a laborer, there for one year and a half , makes $28.400.00 a year and has lived with us for one year and six months.

To make things worse we received a title in the mail for Meagan's truck and it had Holly's name on it. Holly and I went to Gates around 4/18/03 to find out what has happened I gave Mr. Oliver the title and at that time he told us he had Holly sign the wrong papers.

I also handed the loan application papers to him and ask him why he lied on them. He informed me he only puts down what the applicant tells him.I explained to him that Holly told me that they never ask her anything but where she works Mr. Oliver looked at Holly and then told me once in awhile they so they fill it in later. I told him that was wrong and he falsified her loan application so the bank would give her the loan.

Mr. Oliver went into another office talk with Don Stewart.When he came back we where told that her car has been sold it may take three or four days but they would get it back and void the deal. I told him to get the car and give me a call but he had to get the title straightened out for Meagan's truck. That was the last time we talked to Mr. Oliver every time we called he wouldn't return our calls or he was with somebody.

There were days that we called two or three times and all we wanted is to find out what was going on and if they found the car. I was getting tiered of waiting after a couple weeks so I called the South Bend store and left a message for Mr. Gates to call me. Not sure how long it was but I finally received a call from Steve Law and the last he knew they were looking for the car Holly traded in and they would call when they found it.

More time past and we where still calling to find out what was going on leaving messages but nobody was calling us back. It was the first or second week of May by know, Meagan had her truck for two month and the second set of temp. plates had expired, which I didn't know that a dealership could give two temp plates. Holly's temp plates had ran out and she couldn't buy plates because she didn't have a title to her pickup.

So know I have two daughters diving without license plates and Gates not returning our call's. The only thing left for me to do is call in an attorney for help. We had a meeting and explained the hole thing to her and at that time she also called Gates and ask to talk to Mr. Oliver but he was in a meeting so she left him a message to call her back.

After a couple of days I called her back to find out if they got back with her. I found out she had been calling, leaving messages and never received a call back. By this time I knew Mr. Oliver never intended on calling nobody back so I made another call to Gates and finally Steve Law called me back who is the general sales manager.

This is know around the middle of May and told me they found Holly's car but we needed to bring in 3200.00 they paid off Holly's personal loan for and they would give back the car and void the hole deal. I ask Mr. Law that I would like to have every paper my two girls signed to buy the trucks b/ I needed to find out how Holly ended up with both trucks. He assured me that they DID NOT sell Holly two truck.

They sold a truck to Meagan and a truck to Holly but he would get me the papers I needed. My attorney called me right after this and said she would go talk to them in person since nobody had ever got back with her. Later that day she called me from Gates and Steve Law told her the same story except they wanted Holly to sign a waver holding Gates harmless against any further litigation which they were going to fax to her the next day.

Over a week later I again called Steve Law and ask where the paper was and why he never did fax it to my attorney. He informed me that this was in-between me and him. But after all that has happened I still wanted my attorney to check out what I was to sign. I told him I needed it faxed and I would meet with him that night at six o'clock 5/27/03.

At four thirty I had Holly call Huntington Bank to find out if Gates had contacted them about paying off her loan. They informed Holly that they have not heard from Gates and just before we left my attorney called and Gates never fax her a copy of the papers we where going to sign.

I still had my meeting with Mr. Law but I told him Holly couldn't sign the paper b/ he lied to me again. I told him my attorney never received a copy in her fax like he said he would do. He told me that he had faxed it and he had conformation that he did and he also said Don Stewart was there when he did.He told me if my attorney told me she never received the fax that she was a lire.

All the papers that I had requested that the girls signed again he told me he would get where not there. Again he would get them but it couldn't happen till the next day b/ they were at the downtown office. When I was going to give him my fax number he said he wouldn't do it by fax after all of this we would have to come back for them.

I told him I wanted to find out how Holly ended up with two trucks b/ Holly told me she co-signed for Meagan's truck and Lance Oliver also told me Holly was a co-signer. On the phone Mr. Law assured me that Holly didn't buy two trucks. I told him Holly will not sign anything till the title gets changed over to Meagan's name on the one truck.

He informed me that's not possible because Holly signed for both trucks so she bought both trucks and if I didn't like it I had better get an attorney but it better be a good one b/ it will stick. One time he said Holly didn't buy two truck then he tells me she did. That is where we are at this time.

During all of this my daughter, wife and myself were calling the backs witch gave the loans to Holly and trying to get some help from them. Huntington bank was one of the banks that gave Holly a loan was very helpful and sent us all the papers that we needed.

But on the other hand GMAC was called 4/8/03 gave us the run around and told us they would fax us the papers within 72 hours never did. Three weeks later after call after call they transferred me to a gentleman in another department they finally sent Holly the paper work. With that paper work we found another screw up of Gates. On the confirmation of accidental physical damage insurance had Meagan's insurance company and policy number but they had Holly sign that she had that insurance.

At the bottom of the paper it has dealer confirmation and in the box name of person contacted someone typed in ext. 3501. That shows me someone from gates contacted Safe Auto and confirmed she had insurance because it looked like Lance Oliver signed the paper. I ask Don Stewart on 5/27/03 at or meeting how could you confirm that she had insurance when that was not her company. He told us that they didn't have to confirm that a customer had insurance that the Bank did they do it as a courtesy.

The other thing I don't understand is when Holly bought the one truck everything was dated 3/27/03. That is when she did sign the papers to buy it. But Meagan's truck all the paper work was dated3/22/03. Holly never set foot in Gates till 3/25/03 know how can she buy a truck when she is not there?

I absolutely agree. I certainly don't like the things that car dealers do either, but let's get real here. 18 and 19 year olds are fighting and dying overseas, but yet yours somehow can't be held accountable for the idiotic decisions they made? Please, tell us what makes them so special. Why should they get a free pass on this?

"We can't get it to sink in". Well, no s**t! So here's what you do - you let her get stuck for the bill this time, instead of bailing her out, and see how fast it "sinks in". If not, then exactly what age DO you think someone should be held accountable for their actions? When will they grow up and stop running to daddy?

Again, I don't condone the actions of the dealer (assuming you have reported them correctly), but neither do I agree with letting the buyers off the hook. Good decisions come with experience. Experience comes from BAD decisions. Bad decisions are usually expensive. They clearly don't understand that yet.

In 1991 I purchased a GEO Prizm from the subject dealer. I, in a moment of foolishness, purchased a GM Silver warranty extension. (My first and last such act of stupidity) I specifically said I wanted a GM Silver policy, as that is on record with the car serial number, and is good nationwide.

To cut to the chase, I periodically contacted GM Chevy division to make sure the warranty was in effect. Four months later, no record with GM. I went to the dealership and inquired as to why my GM warranty extension was not yet a matter of record. First I was told I was beyond the 90 day refund (from GM) policy. What %ucking gall! I told them I knew d**n well they mever sent the money to GM. The next explanation was: (Quote)"We gave you a much better warranty. It's an 'in house' warranty that covers EVERYTHING , unlike the GM warranty". I next asked about repairs during a trip, at another dealership. The next load of bull$hit was: (Quote)"Just bring us the bill and we'll reimberse you".

At this point I DEMANDED my money back for the warranty (money) which they kept. I was told "it takes two people to authorize and sign a check, niether of which was on staff at that time. By this time it was getting close to their closing time. I was asked to leave. I told them I WASN'T leaving, and told them to call the local police, sheriff, or state police and declare they had an unruly customer who refused to leave. I made my self comfortable as they turned out the lights. They then told me they were calling the police. I reminded them that was my idea first, and they'd be lucky to get home by 10:00PM after we exchanged stories to the police. I also handed them my lawyer's card indicating any future dialogue would occur through my lawyer.

Suddenly, a MIRACLE! No call to the fuzz, but SHAZAM!..... I was handed a check for the full amount of the scam warranty.

Car dealers-you gotta' love 'em. I can never determine whether their dishonesty outweighs their stupidity.

The chip on my shoulder weighs heavily upon entering a new car dealership.

Thanks to the Great Thorn & Rip-off Report

Have had a hard five month's but thanks to the Great Thorn and the Rip-off Report I recieved a offer in the mail yesterday from Gates Chevy.

I ask the Great Thorn for help and he flooded me with people to call and email, and with that help I went to work. I sent out over a hundred emails, then when I didn't get a reply I sent out more, just to let them know I was not going away any time soon.

Gates didn't think that I would last this long but I filled a camplaint with the BBB and Gates wrote them back that the matter was taken care off. Then all of the sudden my complaint was thrown out, b/c my daughter had to file it. We had to start all over but know we are going to arbitration. I COULD USE SOME HELP FROM THE GREAR THORN ON THIS B/C I KNOW I AM UP AGAINST THE DEALERSHIP BUDDYS.

Still have one truck, and I fell Gates has lied to GMAC so much that I don't get anymore calls. Get this, GMAC is going after Gates for the loan. They are making them buy the truck and I still have it, so Gates will have to get it from me.

Dealers are not as smart as you think. I contacted the Attorney General and recieved there letter today, it looks like Gates tried to blow them off b/c they thought that if they didn't respond the Attorney General, they would for get about it. They didn't and Gates had to scramble to come up with a new settlment.

Gates told them my one daughter bought two trucks, and my other daughter did not buy anything. How can this be? Gates gave her a 30 day plate, then after the title was put in her sisters name they gave her an extra 10 day plate. How can they give out temp plates to somebody with out selling them a car.

She signed for both plates but they never gave her the paper work. Can anybody out there tell me how I can get a copy of the temp. plates paper work that she signed.

Do you know they had the balls to send me a letter and tell me if i didn't give them the money back that they paid off my daughters personal loan, they would file charges against her.They gave us ten days, well that was a month ago and haden't heard anything.

Try this, when the rip-off dealer has a sale and a local DJ from a radio station is standing beside the manager telling everybody how goog a deal he is giving. Email that DJ and let them know how they treat there customers. Didn't you know good but the thing is every where Gates goes my name comes up.

When you read this do me a favor and go to Gates customer service on line and tell them the Newcomb's are not going away.

Now I can't promiss you that any of the above will do anything, But I can promiss you that if you use all of the above contact info, your dealer will know that they have been EXPOSED in a big way.



I would like to see some of the dirty car dealer employees go TO JAIL when they commit fraud. car dealers have been liying on car buyers credit apps for years and getting away with it.



To all who read this, if you would like to see if you favorite car dealer likes to play games, try this. call up your auto lender and ask them to send you copies of all documentation that your car dealer sent to them at the time you bought your car.



You my fellow American might get a big surprise as to what your dealer might have written in on your credit application before they sent it to your auto lender.



Note to Steve: I am sorry as to your situation. I would not give up the two trucks untill after I got a good chance to tell a jury in a court of law what has happend to both of your kids.



A jury needs to see all of your documentation that you have on these two VERY DECEPTIVE car deals.

Talked to another Attorny today, same old s**t buyers beware. Why is it ok for salesmen to lie, he said that is what salesmen do it is your fault you let them do it to you.



THIS IS A NINETEEN YEAR OLD KID



Lance Oliver and Gates Chevy should be prowd they used a nineteen year old to put food on there table.
