Gateway put us in a car, in a contract and then repoed it for no reason with no notice. Chicago Illinois
On May, 26th 2008 we went to Gateway to buy a car. Let me just say this is after we went there a week earlier and we're dicked around for 6 hours and left mad. Then on Memorial Day we recived a call from the sales guy saying " oh sorry for your bad experience, however we got u approved for such and such intrest rate through this bank, and we are having a huge sale, we can have you in and out in a new car real fast because we have all the bank stuff done.
So we go back in with a positve adittude and our 6 month old daughter like last time. It went okay we negoiated an okay price, with decent monthly payments and even 2 oil changes and car washes for life. Cool right!!!! NO, the beginging of the nightmear.
So about 4 or 5 weeks go by no plates come, no paperwork from the bank, no nothing, I took out a money order for my first payment which i was told was due June 26th 2008 and waited. On or around June 21st 2008 we got a call that something was messed up and we needed to come and refill out paperwork. Which is called a "bait and switch" according to the lawyers i spoke with.
Now we left messages saying "hey if your gonna change the price, the payments, or the intrest rate let us know and we will just bring the car back and get our down payment back" no real response or strait answers after leaving about 11 messages. So we planned to go down Sat June 28th 2008 but called to see if we should bring the car with to return or find out if everything is staying the same, no answer from Gateway.
Wed Morning July 2nd 2008, i wake up, go outside with the dog, and guess what, My Car Is Gone!!! no phone call no warning, Mind you i have my daughters car seat among alot of other valuable thihgs in my vehical.
We are going to go down there today (July 2nd 2008) to get our down payment back and go else where, but who knows whats going to happen next. Just Beware I don't reccomend Gateway in Chicago to my worst enemy!!!!

You failed to make even one payment.

They had every right to repo the car. You don't handle their lack of return calls by refusing to make even one payment. You go down to their office and drop off the payment as per your contract.
But----It will depend on the language in the financing contract; most actually give more rights to the dealership in circumstances like this (to bait and switch and make you return the car). That doesn't make what did right.
