Complaint Review: GC Collection Agency

GC Collection Agency Declared themselves as part of the Federal Government and will garnish my disability checks if i dont agree to their changes Columbus, Ohio

  GC Collection Agency contacted me and set up a payment plan to pay back my student loan! Being disabled and on disability checks  they set up a payment plan called the WD Ford payment! Where as  i pay $5.00 a month  due by the 15th of each month!   


For the past few months ive been making these payments and on time !  Now they have called and a guy named Sergual  told me   that they are going to make an increase in my payments and if i dont comply they will garnish my Disability checks and he claimed that their Agency was part of the federal Government and i had better work with them or else !   


 What do i do?

Student loans are government backed loans which makes the rules for them different. They have the same rules as child support basically. You cannot file bankruptcy on them and your Disability/Social security  can be garnished to pay them back. In fact they do not even have to get a judgment/ garnish order from the court, they can do it without going before a judge. Do NOT make these people mad because they can and will take up to half of your monthly checks! Try to work something out with them that you can afford and do NOT default on t your payments. If you do they can and probably will make your life a living hell!  FYI~ the company  that is calling you is probably the servicing company for the student loans ( they hire outside servicing companies) VERIFY they are really who they say they are first because you do not want to get scammed! Good luck!

Under federal U.S. law, SSDI checks are not garnishable by creditors. You were not obliged to consent to pay even the $5 a month you're paying now.


You can verify whether the person contacting you really is with the federal government. If he is not, you should report him to the FBI, because claiming to be a federal employee without being one is against the law.


Collections people often use threats and intimidation to get their way. In reality, they have no power beyond sending you harassing letters and making harassing calls. They are among the most toothless members of society and often need to be put in their place.
