My brother is being sued by the Linn-Hert-Geib funeral home of New Philadelphia.

The problem arose after losing our mother in March of 2014. We along with a long time family friend met at the funeral home to make arrangements with funeral director Nathan Douglas. Nathan had us take a paper to John Stephens (Mom's husband) to sign to release her life insurance money to the funeral home and to finalize everything. The three of us took the paper to John, we explained what it was, he told us to go ahead and handle everything and signed the paperwork and we returned it to the funeral home. After some time John went to the funeral home and claimed he did not sign the paperwork. The funeral home decided to rewrite the contract thereby releasing the insurance money to John instead of them. Now the funeral home claims we owe the money not John.

We have had to retain an attorney to protect our rights, therefore spending money we don't have. After obtaining copies of the paperwork our attorney agrees that all of John's signature matches on all documents. Can the funeral home just rewrite the contract as they see fit, it just doesn't seem legal or moral.
