STATE CONFIRMS GRAND THEFT.....

Hi DeeDee I spoke to you earlier about the state statute 328.17.

As per our conversation it is my understanding as a marina if you try and use the statute 328.17 you must hold and be in possession at all times. If the boat you are claiming owes you money leaves for any reason you cannot claim the statute and do a non judicial sale correct? At that point as a marina I would have a civil matter claiming back rent owed? And as you mentioned if the vessel leaves for any reason we as a marina would not be able to go get it and bring it back to our possession under the statute because that would be theft correct? So to sum it up as a marina I would need to hold vessel there to claim statute then follow guidelines to do a non judicial sale? if not we cannot go get yacht then bring it back and sell it under the statute. Thanks again and please let me know if the above is a correct assessment of the law.

i almost forgot would we be able to go take yacht and bring back to our possession if we notify him first by mail(before boat leaves marina) we are claiming the statute 328.17 then he leaves after getting notice?

You are correct in all that you stated. I apologize for not emailing you yesterday like I said that I would. The only thing is the P.S. is incorrect. If the boat leaves your possession for any reason, that then becomes a civil matter and you would have to get a court to say that you can go get the vessel. Please let me know if you have any further questions.

I spoke to you on the phone several minutes ago and wanted to make sure I had the facts straight so I can forward this to my buddy in Florida. Under statute 328.17 if we did not have a written lease with a boat owner we COULD NOT use this statute to do a non judicial sale of vessel correct? also if the boat leaves the marina for any reason and doesn't return we as i understand CANNOT go get it and bring it back to our possession correct? and as you said even if we had possession the whole time still without a lease we could not do a non judicial sale under statute 328.17 correct?

As many of you who have written have asked " Why isnt Gemstone resorts responding"????

Well they have two options to this...

1) Jeff McIntyre can go on the record like he did during my call to him and lie saying Boswell uncovered the theft and got the criminals prosecuted or

2) He can go on the record and lie again..


EITHER WAY THEIR HOTEL MANAGER STEVEN BOSWELL WAS INVOLVED IN THE THEFT OF MY FAMILYS YACHT AND COVERED UP THE ARSON OF THE YACHT WHILE IN HIS POSSESSION. AS IVE SAID ALL ALONG IS THIS THE TYPE COMPANY YOU WANT TO PLAN YOUR STAY WITH? THEY KNOW THEIR MANAGER BROKE THE LAW AND NEED TO DO THE RIGHT THING. THE PUBLIC SAFETY SHOULD NOT BE ALLOWED TO BE PUT IN JEOPARDY BECAUSE A MANAGER WAS HIRED WHO COMMITTED A GRAND THEFT AND COVERED UP AN ARSON THEN HIRED TO RUN A RESORT AND UPPER MANAGEMENT LYING TO COVER FOR HIM.

After speaking to Robert last night, I was shocked when he played the recorded conversations he had with Gemstone Resorts management. This management official clearly says, Steven Boswell was the manager of the resort at his last job and "HE" uncovered the grand theft and it was because of him the thieves were prosecuted. This is very untrue because Boswell ordered the theft and took part in hiding the stolen property. Gemstone Resorts management also goes on to defend Boswell as being a very nice guy who is friends with their top brass.

It's obvious these facts were thought out by Gemstone Resorts and they clearly are lies. I also spoke to Kevin Mc Carthy, the other victim they sold the stolen yacht to, and he tells me, " This was totally illegal and Steven Boswell was in on the illegal sale."
This confirms Boswell was not the SUPER HERO Gemstone Resorts International made him out to be. This is very disturbing granted Gemstone Resorts International is in the property management business and should be very concerned for not only their own customers safety but a major crime that happened in their own industry.
If Gemstones response was, "Bosewell took part in bringing the thieves to justice" then why was he personally taking part in the illegal sale?

I WANT EVERYONE READING THIS TO KNOW, ANYONE IN A MANAGEMENT COMPANY THAT FALSIFIES INFORMATION TO MISLEAD WHO THEY THOUGHT WAS A BUSINESS POTENTIAL CLIENT IS VERY SAD.


THIS SHOULD BE ALARMING TO ANYONE WHO IS CONSIDERING STAYING AT ANY RESORT BECAUSE IF THEY LIE FOR THEIR THIEVING MANAGER WHAT ELSE WOULD THEY LIE ABOUT??
