I filed a complaint with the Better Business Bureau on 12/27/2007 in regard to this company. I obtained a payday loan to be paid back on 12/31/2007. I followed the instructions in their contract to the letter and faxed them their form to authorize withdrawal of what I owed plus the fee on 12/27/2007. They called me immediately after I faxed the form saying it was too late. The form had to have been faxed to them by 10:00 am in order to meed the cutoff time, and now if I want to avoid another $90 extension fee, I would either have to send the money Western Union/MoneyGram no later than 12/31/2007 or wait until my next payday and they would withdraw the money then along with ANOTHER $90 fee.

I didn't think I should have to pay any more fees for them to get their money, so I started proceedings with the BBB. They responded to my complaint by saying that I faxed the form too late. It needed to be 4 business days and I faxed it with only 2 business days until my due date.

None of the information I have from them ever said anything about a 10:00 deadline, not to mention in which time zone. Also there was nothing about what they considered business days. In the complaint rebuttal on the BBB site they contradicted themselves first saying that I didn't fax the form on time (by 10:00 am according to the woman I spoke with on the phone/at least 4 business days before due date by the contract).

Then later in their rebuttal they told me that in order to have the withdrawal taken out on time for my second due date of 1/15/2008, I would have to send the ACH authorization form to them by 1/10/2008. Incidentally, the ACH form that I was to sign and send to them was promised to be sent to me via email at 5 business days before my due date. I never received any such email from them.

One of the many things that is peculiar about all this is that it is unclear as to what they consider business days. I faxed the first ACH authorization form to them on 12/27/2007 for my due date of 12/31/2007. They said it was sent 2 business days before my due date. To me, that would mean that they did not consider Saturday or Sunday as business days (I assumed this as they never told me what they considered business days), and also did not consider the day I sent the form as one of those "business days". But then when they said that I would have to fax the second, updated ACH authorization to them by 1/10/2008, I didn't understand. 1/10/2008 was a Thursday, and my due date is Tuesday 1/15/2008. If they don't consider Saturday or Sunday or the day you send the form, that would only be 3 business days.

Mind you, none of this is clarified on any of the forms or correspondence I received from them. All of this is what I have found out since I filed a complaint with them.

I can't believe there are companies out there that prey those of us that are trying to survive financially only to steal from us more and more of our hard-earned money.

They have not responded to my last rebuttal at the BBB. Anyone with any advice on how to deal with these idiots???

I was also ripped off by Geneva Roth. The only way i could get them to contact me and send me the form to be faxedwas this. I e-mailed them and informed them that all I wanted to do was repay my loan. Since they made it nearly impossible to do anything but pay extention fees, I had to play hardball. I informed them that if they didn't give the necessary forms, that I would be forced to close the checking account. cutting off their ability to sleal my money. As you may have guessed, I strangely received an e-mail from Geneva Roth, with all the necessary info. It is unfortunate that only threats will get results, but that is just how these scam artists operate

This company borders on fraudulant activity by withdrawing extension fees as long as you don't return their forms to them "in due time." It is funny that every time I have asked them when to send the form back by, the date and/or time has changed. Not to mention that they never sent me the form via email - as stated in their own contract - in the first place!

I understand that I risked this situation, but I truly did not think that companies could operate this way. Excuse me for thinking that other people have the same integrity that I do.

Well, they withdrew another $90 fee. But, interestingly, under a different name. How many names does this business LEGALLY have???

Geneva Roth Ventures. LoanPoint USA. Now they used GRC Funding as the name for this withdrawal.

Very suspicious don't you think?
