Starting in July 2015, Mr. Masters , a resident of Florida began receiving threatening e-mails and phone calls from Joe Michaletz, a resident of Montana.

These threats have continued through March 2016, have intensified in volume and severity of threat, including extortion and threat of bodily harm.

These threats have also included family members and business associates of Mr. Masters .

We find the following facts to be true and correct :

#1) All threats have come directly from the telephone and email of Joe Michaletz, listed at :

#2 ) All threats are criminal activity and violations of the following codes and statutes:
(A)Montana code 45-8-213

(a) with the purpose to terrify, intimidate, threaten, harass,
annoy, or offend, communicates with a person by electronic
communication and uses obscene, lewd, or profane language, suggests a
lewd or lascivious act, or threatens to inflict injury or physical harm
to the person or property of the person. The use of obscene, lewd, or
profane language or the making of a threat or lewd or lascivious
suggestions is prima facie evidence of an intent to terrify,
intimidate, threaten, harass, annoy, or offend.
(b) uses an electronic communication to attempt to extort money or any other thing of value from a person or to disturb by repeated communications the peace, quiet, or right of privacy of a person at the place where the communications are received;
(c) records or causes to be recorded a conversation by use of a hidden electronic or mechanical device that reproduces a human conversation without the knowledge of all parties to the conversation. This subsection (1)(c) does not apply to:
(a)
A person convicted of the offense of violating privacy in
communications shall be fined an amount not to exceed $500 or be
imprisoned in the county jail for a term not to exceed 6 months, or
both.
(b) On a second conviction of subsection (1)(a) or (1)(b), a person
shall be imprisoned in the county jail for a term not to exceed 1 year
or be fined an amount not to exceed $1,000, or both.
(c) On a third or subsequent conviction of subsection (1)(a) or (1)(b), a person shall be imprisoned in the state prison for a term not to exceed 5 years or be fined an amount not to exceed $10,000, or both.
(B) Montana code 45-5-203

45-5-203. Intimidation.
(1) A person commits the offense of intimidation when, with the purpose to cause another to perform or to omit the performance of any act, the person communicates to another, under circumstances that reasonably tend to produce a fear that it will be carried out, a threat to perform without lawful authority any of the following acts:
(a) inflict physical harm on the person threatened or any other person;
(b) subject any person to physical confinement or restraint; or
(c) commit any felony.
(2) A person commits the offense of intimidation if the person knowingly communicates a threat or false report of a pending fire, explosion, or disaster that would endanger life or property.
(3) A person convicted of the offense of intimidation shall be imprisoned in the state prison for any term not to exceed 10 years or be fined an amount not to exceed $50,000, or both.


Florida Statute 365-16


(C) Florida 
Fla. Stat. § 365.16. Obscene or harassing telephone calls
(a) Makes a telephone call to a location at which the person
receiving the call has a reasonable expectation of privacy; during such
call makes any comment, request, suggestion, or proposal which is
obscene, lewd, lascivious, filthy, vulgar, or indecent; and by such
call or such language intends to offend, annoy, abuse, threaten, or
harass any person at the called number;
(b) Makes a telephone call, whether or not conversation ensues, without disclosing his or her identity and with intent to annoy, abuse, threaten, or harass any person at the called number;
(c) Makes or causes the telephone of another repeatedly or continuously to ring, with intent to harass any person at the called number; or
(d) Makes repeated telephone calls, during which conversation ensues, solely to harass any person at the called number, is guilty of a misdemeanor of the second degree, punishable as provided in s. 775.082 [up to 60 days’ imprisonment] or s. 775.083 [up to $500 fine].



# 3 ) For the protection of Mr. Masters, his family and business associates, Mr. Michaletz must cease and desist from these activities immediately or be prosecuted to the full extent of the law.


#4) Under Federal Law we are obligated to report these threats to the Office of the District Attorney's 
office of both the State of Montana, and the State of Florida.



Any further communication from Joe Michaletz to Mr. Masters, his family, or business associates will be considered a violation, and will be prosecuted at the advisement of the respective State Attorney's advice
