I just needed to get a little off my back. I started noticing that my bills weren't being paid by a so-called debt consolidation company. I looked around found out that their web-site is no longer there, and their phone number no longer works. I tried emailing them that was also a failed atempt. I started looking around the internet and noticed that their are a ton of us that have been ripped off. I think this stinks and I am willing to help in any way to get these guys arrested and all of our money back.

DEBT CONSOLIDATION COMPANIES CHARGED WITH DECEIVING CONSUMERS
TALLAHASSEE -- A pair of debt consolidation and credit repair companies were charged today by Attorney General Richard E. Doran with failing to provide promised services and leading some debt-strapped customers into deeper financial straits.

A civil complaint was filed in Broward County Circuit Court against Gibson Trust Inc. and Goldstar Financial Systems Inc., both located at 4081 N. Federal Highway in Pompano Beach, and the companies' principal officers, Patrick J. O'Toole, Donna Canty O'Toole and Martha V. Allen. The complaint seeks consumer restitution and civil penalties of up to $15,000 per violation of the state's Deceptive and Unfair Trade Practices Act.

According to the complaint, the companies since at least 1998 have advertised debt consolidation and other services through a variety of means, including their own Internet web site and the web sites of others. In their advertising, the complaint said, the companies promised to negotiate with creditors to lower consumers' overall debt, disburse payments to creditors and provide consumers with professional debt counseling, credit repair and legal services. Consumers were told that by using the companies' services, they could reduce their debt by between 20 percent and 50 percent, pay off their debts in a shorter period of time and avoid creditor harassment, according to the complaint.

"In many instances, those promises were not fulfilled and an already difficult financial situation was made even worse," Doran said. "For a number of consumers, it got so bad they filed for protection under bankruptcy laws."

Among the charges contained in the complaint were:


*The companies did not reveal that consumers' first month's payment for services would not be used to pay creditors but instead would be designated as a fee, and that additional monthly fees would be taken out of consumers' future payments.

*Many consumers who followed the companies' directions and refrained from making direct payments to creditors or debt collectors encountered litigation, which in some cases resulted in the garnishment of wages.

*Many consumers who retained the companies' services actually increased the amount of their debt by incurring late fees and finance and overdraft charges.

*Despite assurances to the contrary, many consumers using the companies' services continued to receive calls from creditors and wound up with negative information on their credit reports.

The complaint was prepared by Assistant Attorney General Marta Moakley.
