My son was stopped by the Gilbert Police Department while he was driving home from the store. He made a left turn at the green light and turned into the "far lane".  This should have been a simple traffic violation.  In my opinion, because and he was 20 yrs old with long hair the officer accused him of drinking and gave him a field sobriety test.  He failed it because 63% of sober people fail this test.  He blew 0.0 on the breathalizer test.  The officer did not give up, he claimed he was on drugs because of watery eys and eyelid trimmers.  The officer performed a half effort DRE process on my son.  The DRE process is a 12 step process in which all 12 steps must be performed correctly.  The conclusion cannot be based on any one step, it must be on totality of the process.  The officer did not preform a proper pupil dialation test or taking of the pulse. He did not ask about medical conditions and skipped several other steps in the DRE process. Still he was arrested and read his rights.  He was given a urine test at the station.  When we picked up our son we were told we could have a independent test done when we questions the legitimacy of the test.  Our independent test, done by a clinic, came back with no drugs or alchohol.  More than likely he will not be charged in 4 months, but it cost us towing and impound charges and the stress of waiting to see if he is charged for DUI.  By the way, he did not get a ticket for illegal lane change.
