On Oct. 4th I received a call from Todd White at Global Timeshares telling me he had a customer interested in our timeshare in Wisconsin Dells. He informed me that to properly handle the contracts, he would have to have me take out an ad that would cost $1,350. Todd was describing how they work with customers to go through lisings and securing financing for prospective buyers. Todd even went so far to call the potential buyer and to do a credit check to verify they could get financing to pay for the purchase. Todd also told me when I talked to the verifyer, I was to tell them there was no promise of a sale. The verifier told me I would receive the documents to sign and send back in 7 to 10 days.
At this point I asked about any cancellation policy. The verifyer informed me that I had 10 days after the receipt of the contract documents to request cancellation. This cancellation request must be in writing and received within 10 days.
On Oct. 14th I received the documents and read through them. I found there was very little in the contract about what I was going to receive. There was only information about an advertising contract. There was no information about finding a buyer and securing financing like Todd described over the phone. Since this is not what I was promised, I wrote a letter informing Global Timeshares I wanted to cancel the agreement. I mailed this out on Oct. 16. On Oct. 17th I made a phone call and left a message informing Global Timeshares of my plan to cancel. On Monday, Oct. 20th. when I didn't receive a call back, I faxed the letter I previously sent
In the meantime, we also contacted our Credit Card company and have filed the paperwork for a dispute. As of Oct. 30th, no refund came back through our card.
I decided to call Global Timeshares on Oct. 30th and after being put on hold for a while, I finally got ahold of someone and asked them about the refund. He said they process refunds on a first come first served basis. I requested to know when ours would get processed. He put me on hold for about 5 minutes and then Todd White came on the phone.
Todd infomred me that I was pulling out of a good deal. Todd said he had buyers who put money down and he had completed a credit check. I asked him to prove it because I didn't feel comfortable with him and the company. He never replied to this request. I had sent the cancellation notice within the 10 days as I was instructed and I wanted a full refund. Todd informed me that I was only entitled to 50% at most because the buyer put down money. He then informed me that he hadn't received the cancellation in Orlando within the 10 days and sometimes it takes 2 weeks to get mail forwarded from Brockton, MA. He said I didn't send the letter certified, so I don't have proof they received the cancellation letter. Then he informed me he had other customers and hung up on me.
I called him back and said I should not have had to mail it certified. I also informed him that I have been working through our credit card company for recovery and hoped he could speed the process along. He infomed me that I committed fraud by telling the verifyer that there was no promise of a buyer. I said that isn't the reason I was cancelling. I felt uneasy about this contract, the company and him as a sales person. The things he was telling me didn't match up with details in the contract he had sent me. Todd again informed me that he had customers to deal with and hung up on me again.
