GMAC Mortage GMAC RESPA Violation Waterloo, Iowa
Does GMAC Morgage have the capability to respond to a simple issue? It all started when GMAC changed my monthly mortgage payment to include escrow for property tax. I always paid my own taxes, but they have the right to do this in the loan docs. The problem is they charged more than twice what the tax obligation would be (see RESPA 2609). I tried to find out why over the phone (what a nightmare) but that was a waste of many hours (on hold for more than hour at a time). I sent my regular payment in but it was returned with a letter stating I was in default. They turned it over to an attorney and 2 years later it's still unresolved. Even their own attorney could not get them to respond. They fired that attorney and now have an attorney that just filed for foreclosure. I have many emails and recorded conversations with GMAC. They stated they made a mistake, but the company is so poorly ran, I don't think they know how to respond... so, I'm going to court. If anyone has the same problem or know about a class action suit addressing RESPA violations, please let me know. Also, I wonder how they positioned my loan in regards to their bailout? they might have benefited from us taxpayers -- they should be exposed and punished!
