I am very upset right now and I was pleased to see that I could make others aware of the deceitfulness of GMAC Mortgage Company.

I bought my first home in December 2005. I was very excited to finally have a place to call my own. Originally, my loan was held by Equifirst Mortgage Company until 2 moonths ago.

First, I was notified on April 17th that my account was sold to GMAC Mortgage on April 18th and all further payments should be forwarded to their office. I had no feeling about it one way or the other. I received a call at WORK on April 20th from "Eric"(no last name given) stating that I was two months behind on my note. I asked him to explain to me like I was 3 years old, how I owed them for March & April and they just aquired my loan on April 18th. Eric told me that because I was in their computer system, my account was placed in the "Default Department" of GMAC. In order for me to get this resolved I needed to call Equifirst and ask them to send over my April payment to GMAC.

It was beyond me how in the world I became an employee of GMAC. I told Eric that this was not my job. I also informed him that GMAC purchased my account from Equifirst, they did not ask me if it was ok to do this or make me aware of their intentions to do this. I just got a letter in the mail.

Second, Eric transferred me to his supervisor named "Wendi" (again, no last name). Wendi told me that they are currently considered a third party to Equifirst and can not go back to them and ask for my payment history. I asked Wendi if she knew how STUPID she sounded!! I told her the same thing that I told Eric...I DO NOT WORK FOR GMAC, I WILL NOT DO THEIR WORK FOR THEM.
I hung up the phone on Wendi.

Needless to say, I received a letter in the mail from GMAC threatening to foreclose on my home. I called the number listed on the letter and tried to explain that they recently aquired my loan from Equfirst and that my payments were made to them. The representative told me that I needed "proof" that I paid Equifirst.

I called Equifirst and asked if they could call GMAC and let them know that I had already made my April payment to them prior to them selling my account. By this time it was the second week of May, I was getting collection calls stating I had never made my May payment. I was dumbfounded, I was trying to figure out how they had automatically drafted my May payment from my account on May 1, but did not have it. After pitching a fit about all these harrassing calls and letters, I was informed that the payment I made for May was applied to the April payment they had not received from Equifirst.

Third, I called Equifirst with GMAC on the line (three-way)and asked Keisha from Equifirst to verify that I had already made my April payment. Keisha verified that they had received my payment on April 4 and that the payment was forwarded to GMAC with the other accounts they sold to them. Keisha provided them with a confirmation number from the transaction, date and time the transaction was made. The representative from GMAC was very thankful and she told me that my account would be noted.

I received a call June 16 at work stating that I was one month behind on my note. Again I asked how was I behind when they drafted the June payment from my account on June 1. I was informed by Diane that they did receive an electronic payment on June 1, but it was for my May payment. I was furious!! I told them that they were a bunch of incompetent employees. I asked if she could see the notations supposedly made to my account in May were the representative actually spoke with an Equifirst representative and was informed that the payment was electronically forward on April 26. Diane told me that she saw no such notation on my file.

Finally, I asked to speak with her supervisor. "Summer" got on the line and I told her how furious I was about all the problems I have had in the last two months with their company. I faxed over a copy of everything I had regarding my payment history with Equifirst, a copy of the verification that the payments had been received as well as the transaction number given to me by Keisha while on the three-way call in May. I was told that they would "investigate" the confirmation number as well as the 13 page fax they received from me and they would get back to me.

Please be aware that GMAC is a very deceitful company. They apply payments that you make to their company to "past due" balances they say you have. If I had a choice, I would move my mortgage to a more competent and reputable company.

Yolanda,

You were able to finance your first home, now you are seeing the effects of mortgage sales and the dealings with GMAC. Before it's too late with GMAC playing the numbers game to try and STEAL your home also, go and find a mortgage company to refinance you. BUT, make sure there is a clause in the loan documents that GMAC CAN NEVER PURCHASE YOUR LOAN!!

Refinancing will probably cost you some money, but trust me and all the people complaining about GMAC, you will be much safer in the long run, plus I personally believe that getting your mortgage out of GMAC's hands, will save you not only money, but heartache, headaches, and the freedom of life the USA as given us and GMAC is STEALING from so many.

I can pretty much guarantee that others that I'm in contact with about GMAC will back me up 100% on this one; therefore this should only be the first of several replies that you get. I did a consumer comment on 6/20/06. You find that comment and you will be able to contact those of us that are serious about GMAC unethical servicing of their loans.

Get started NOW before you are into it way too far. It looks like you have everything in black and white; this is all you should need to get a refinance!
