GMAC Mortgage Company ripoff NO PAYMENT DUE ACCOUNT CURRENT STILL FORECLOSING! ATLANTA GEORGIA

GMAC bought our loan in January,2006. Monthly statement we received said that first due date was January 10, 2007, every monthly statement from there on stated same information in two different places, with no past due amount showing $0.00. I called company immediately to verify the due date, and told them that I thought it was January 10,2006, only to have the represenative tell me that we must have overpaid some during closing when we refinanced with other company, and the date of Jauary 10, 2007 was indeed correct. I asked her to please verify this information with supervisor, I was put on hold, she came back to phone and said that "Yes, this is correct. You are not due for first pymt until January 10, 2007 and your account is current and there is no past due amount owed." I then asked her to please mail me a letter stating the same from their company, which she said would not be a problem. I received the letter shortly after our phone conversation, on GMAC letterhead, stating exactly what I said above. I have kept this letter and all monthly statements. We chose to do home improvements on our home and property since we had been assured by GMAC that the due date wasn't until January 10,2007.


In August, we received another letter from GMAC threatening forecloser because we were supposedly 8 months in default. We never received 1 phone call or 1 late notice from this company. When I explained the situation to them, they didn't care. It was our problem, not theirs, even though they noted and stated that the due date had been incorrectly loaded into their system. But that wasn't our fault either. We went by what their monthly statements and other letter stated. Now I received a foreclosure statement by certified mail yesterday, Sale is scheduled for November 2, 2006. I am scared, my family is scared. We have a lawyer who is helping with this. He has been trying desperately to work out something with GMAC for the last 2 months, only to have them ignore his requests. Before we had to refinance (we had adjustable rate with previous company) we were always on time with payments and this reflects in our credit history. Now GMAC has submitted derogatory credit information on us, this has been put in newspaper for sale. We are humiliated, scared, angry and quite honestly ready to fight. If you have any suggestions, I would greatly appreciate it.

lisa: im gary and i just read you're complaint about gmac mortgage me and many others are in the same boat like dan from south florida. this company knows exactally what they are doing indeed they are making triple profits off of innoccent victumsand add high attroney fee's on top of that as well. this company knows they are breaking the laws and get away with it.

In europe they would get about 30 years for what they are doing. You have to fight hard with this company and they will keep doing it to others as long as they can get away with it. And i applaud all that is working to bring this unamerican company down thats right unamerican these guys do not belive in the laws of this nation just the money profits and the attroneys they deal with.

the attroney are just as bad as well making profits off of innocent victoms as well because they know that 78% of amrericans live of pay check to pay check and have no decent means to come up with the high cost they ask for. ITS IS CALLED IMMBESSELLMENT THATS RIGHT? I HOPW THE MAN UP STAIRS SEE'S WHAT IS GOING ON TO THSE lisa am behind you and all others thPEOPLE THAT HAVE POST COMPLIANTS ABOUT GMAC.

in europe this would have never happend indeed only in american. the old american saying : only in america can you buy a package of 10 hot dogs and end up with only 8 buns good guys and please keep the postings.

Your letter is intriguing but at the same time confusing. Therefore I'm writing a bunch of crap just so you can find us! Once you find us you will be questioned to find out if you are who you say you are!

As far as your case is concerned I would do the following; do a search on Google for information! Do searches for GMAC Mortgage Fraud, HUD Law's, RESPA Laws, TILA Laws, Platoridge, etc.

How do you know that you're about into foreclosure? What are the signs you are seeing?

What does TORT stand for? What is filing a case Pro-Per? Is this the same as Pro-se?

We can look at the closing documents but as we all know the escrow account can and will change every year.

None of us smarter ones plan on settling out of court but yet, some of us don't have the knowledge you appear to have. Can you explain further to us lay-men of what you mean?

Did you get the message, and willing to answer the questions?

I ALSO WORK AS A ACCOUNT EXECUTIVE FOR A MTG CO. MY SUGGESTION TO YOU WOULD BE TO TURN GMAC INTO THE DEPARTMENT OF CORPORATIONS FIRST. THEY ARE LIKE THE POLICE FOR MTG LENDERS. SECONDLY: FIND A TORT ATTORNEY AND SUE THEM IN CIVIL COURT. THE TORT ELEMENTS THAT YOU WILL SUE FOR ARE PROFESSIONAL NEGLIGENCE, BREACH OF CONTRACT AND LASTLY INTENTIONAL INFLICTION OF EMOTIONAL DISTRESS. MAKE SURE YOU SEEK GENERAL AND SPECIAL PUNITIVE DAMAGES WHICH WILL ALLOW TO SUE FOR ANY AMOUNT OVER $25,000. SOCK THEM WITH A 5 MILLION DOLLAR CIVIL SUIT AND I AM SURE YOU WILL GET THERE ATTENTION. MAKE SURE YOU ASK FOR A JURY TRIAL.

I have emailed joe twice at the email address I found at homepage. Please check there. Judge issued injunction today until this case is settled. Now for the next steps. I have sent a qualified written request for pymt history, yet to be received. I swear I am trying hard to get to you. just check the email address on joe's webpage. HI Lisa,
Hate to say it but welcome to the club! First suggestion I have is doing searches on the net. Search for HUD, Platoridge, FHA, and Lawyers in your area, etc.
Second I would recommend to learn how to be an accountant really fast, get a payment history from GMAC, yea I know you have not made a payment but by getting your payment history it will also show you what GMAC is now charging you. Do this by sneding in a "Qualified Written Request" one of these forms can be found at HUD's website.
Most of all is the very first step I said above do that search, you will find valuable information!

Dear Joseph,
All links are being deleted. I have no way of getting into touch with you, but I desperately want to. So any advice you could offer, websites etc would be great! We are very angry. We are fighting and would love to join together with everyone else to file class action lawsuit. We do have a personal lawsuit filed already and it is for a large sum, but ultimately the outcome lies within the court. Thanks for replying to my complaints and please know that I didn't ignore your letter, I tried to reply, but evidentally it was deleted.
What was the outcome on your situation with gmac?

There is a group started that need and want your help. In the same turn most of us will help you out the best we can. No one can fight an army like GMAC alone, but if we combine and fight one army can and will beat the army that is breaking so many laws! Who am I talking about? GMAC Mortgage Corporation!

Hi again. How can I get into touch with other consumers who might be having similar problems with gmac and foreclosure issues with this company? I understand there is a class action lawsuit that is or has been filed and I am seriously interested in participating if we are eligble to do so.

I am only on the internet to check items I sell on ebay on a regular basis and to also check this website for any new advice or information on this great website! I am trying to do alot of research on my own, so I can be prepared.

We have a hearing scheduled on November 8, 2006 regarding this terrible mess. If anyone could please direct me into any websites or provide any information I would so greatly appreciate all help offered.

I will be back online tomorrow to check out my ebay account on a women's leather coat I am selling, so I will also check back with ripoffreport.com to see if anyone has posted a rebuttal. I know this is kind of vague, but I am begging for any kind of help you possibly could offer.

Thanks so much Dan for replying. We have already filed a lawsuit against gmac last week. You know the more I think about it, the more I am ready to fight this dumb @$$ company. Beleive me, I could use all the help I can get. If you could direct me to ways of getting in touch with you or your friends. I would appreciate it! Have you heard of any positive outcomes with GMAC on foreclosures?

I just wonder if you can actually win. If you want to read between lines feel free to email
sometime. Any suggestions, support etc would mean so much! Our lawyer, said with all of the substantial documentation, that something would have to work out. He is a good attorney and I have a lot of faith in him.

If we lose our house, it will not be because we went down without a fight..a big fight! Anyway, I look forward to hearing from you and anyone else that might want to e mail us. thanks again and have a great weekend!

Lisa, first stop being humiliated and scared. Start being very angry. From what I have read you are sitting very pretty as far as sueing the crap out of this dam company like the rest of us. We have and are being ripped off by them. GMAC has no idea of what the hell they are doing.
you say you have an attorney. If you have hired him its time for him to get agressive. Tell him to file a counter suit against gmac NOW. Ask for millions. From what you have told me this is clearly their mistake and they should correct it. You did the right thing by getting documentation from them now. Ask for more. request an account sumary from them. This will show where monies were paid.
