GMAC put forced placed insurance on my house January, 2005 for the previous September, 2004. I, as well as my insurance company, faxed the information showing I had insurance during that time.

After receiving another statement showing the forced placed insurance, I called & tried to make my payment over the phone & correct the insurance information. GMAC insurance dept. had already corrected the issue as of 2/7/05.

The insurance dept. 3 way conference called me with the billing dept. to explain the forced placed insurance had been removed. The billing dept. would not let me make a payment without the forced placed insurance because they don't accept partial payment.

Although, their insurance dept. explained it was NOT partial payment because the insurance had been removed. The billing dept. told me to call back in a week for the insurance correction to post to billing.

This went back & forth for months. I continued to call for months & sent faxes & letters, etc. Needless to say, end of May I received a letter stating they were going to foreclose on my house the 2nd week of June.

I contacted a lawyer who advised me to pay the foreclosure fees so I did not lose my house in the mean time, but to add that I was contesting the foreclosure. I did so. I had also sent a certified letter to GMAC explaining the situatin again & I received a letter stating they would look into it & I would hear from them in writing within 20 days....to day (11/21/05) I've heard NOTHING!

This is just a a quick synopsis of this situation... I have loads of faxes & people's names I spoke to who never returned my calls or tried to pass the buck. I went so far as to contact a local GMAC Mortgage loan officer... she too advised me to find a lawyer because they were giving her such a hassel.

Now, I need to refinance my loan to get it out of GMAC & can't because of my credit from them!! This is a HUGE circle of madness! When I paid the attorney's fees I got an itemized statement of the costs...there was NO forced placed insurance included in the itemized cost!!

It is ridiculous when there own insurance dept., also, instructed me to contact an attorney. I am doing so, but in the mean time, my credit is ruined, I'm out all the attorney fees, my cell phone bills have been crazy from trying to get ahold of someone there, the copies, the faxes, the headaches... it's consumed my life!!

I've got an attorney, I just need to refinance! If there is anyone who wants to contact me regarding a similar situation, please do so! It's terrible that such a large company is getting away with all of this!!!!

hey Dan, I was sooo excited when i got the letter from them. I immediately faxed it to my lawyer, who I will have you know, is VERY excited, also. I am NOT done with GMAC!! I, as well as my lawyer, finds it very interesting that after all this time I speak to one lady & she reverses everything. I've spoke to a million people at GMAC & to great lengths & I only spoke to her for less than 5 minutes!! I explained I could fax her my notes & all the info I had & she said it wasn't necessary... she could see it in their own information. Now, she got all of that in just a 5 minute conversation??? Yeah..OK! So.. NO I'm certainly not done with this... and I certainly would never recommend them to anyone. Thanks for all your info Dan. It has helped me tremendously!!

renee glad you were able to fight this and come out with a good news situation
i belive gmac is finally realizing they did some major screw ups at my last hearing they admitted that they did three things wrong also and their attorney put it in writing for the court docs
now for some poss better news i spoke to an attorney on thursday hes interested in filing a class action suit against gmac i told him about this site and he went to it while we were on the phone i told him that i have spoken to 4 people that i know would be interested in fileing so i will let you all know what happens
renee just because you won i hope that you dont stop bad mouthing gmac please keep telling people what they have done to you and others so they arware of what they do to people and that we all need to stop fueling this monster by buy their goods cars/trucks /mortgages etc keep the word out there thanks daniel

Just a quick note...I received a fax today. GMAC has admitted their mistake & they are correcting my credit report!! Finally, it is all over. Well... most of it, anyway. I, at least, got them to admit it was their mistake & not mine! This site has been a great source of strength & support! It was nice, although at someone elses expense, that I wasn't the only one out there. As i apologize for those of you who have had such a hard time, PLEASE, PLEASE just hang in there!! your d**n will come.. I promise! Thank you

Got a BBB report from Iowa last week, they were contacting GMAC regarding my complaint. At least Iowa State BBB was willing to attempt contact. In the meantime, contacted my Loan Office Ladies who were trying to help. Unfortunately, they were out of town (legitimately!).

BUT, spoke to the District Manager & asked who I should contact at GMAC just to get some response regarding my situation. Explained very little of situation to him & he said he had an email address & he would see what he could do for me. I wasn't holding my breathe...I've learned by now to be very careful.

Today, got a letter from Iowa BBB that GMAC had contacted them & indicated they had contacted me directly. Just happened that I got GMAC letter today, also. So... the only thing the letter said was my loan went to foreclosure due to non payment, not the forced placed insurance. Well, duh!! That was a given. I COULDN'T make my payment...they wouldn't let me cuz the Forced Place Insurance had not been adjusted off. Tried to call lady back regarding letter & left message for her to call me back.

After leaving message for her, I checked my answering machine. There was a message from another lady who got my name from the District Manager! YEAH!! Houston... we have contact!! Finally, someone has called me back...I have some contact anyway. Explained in short my situation up to day & the letter I had just received. She explained she worked very closely with the lady in the letter. Long story short... Her notes indicated the Insurance Dept. made the adjustment Feb. 05 & it was not indicated on any of my statements thru June '05...therefore, the reason they would not accept my payments! She said she was quite sure they would be correcting my credit report, but she would call me back with further information. I went grocery shopping & came back... hour or so later! Message on my answering machine (and it's recorded!!!)...

THEY ARE CORRECTING MY CREDIT REPORT & REMOVING THE FORECLOSURE THAT WAS REPORTED!!!! YEAH!!!

I can't tell you how I felt tonite. I'm scared that its just a dream, but my husband & several others have listened to the recording...so I know it's not something I'm just dreaming!! Hopefully, soon this will ALL be over!! What an ordeal!
Don't give up!! Be persistent! Try everything! It's tough, but the benefits are GREAT!!!

This site has been VERY helpful! Reporting to the BBB is something everyone should do when they've had a problem!

Last week I had a customer come into work who is a GMAC Loan Officer at one of our local branches. Her & another co-worker asked for my information regarding this entire situation. I immediately made copies of everything I had & gave it to her the next day. I, also, had told her about this website & she obviously researched it.

When I was dropping my information off to her she indicated she had already contacted her Regional Manager and she told him about this website! She suggested to him that not only should he research this, but he should contact the Regional Manager for Iowa & make sure he checks it out, also. I haven't heard anything & I'm not holding my breathe, but it is the holidays & most of their offices haven't been open since I dropped off the information. I'll keep my fingers crossed, though.

In this whole mess I had reported GMAC Mortgage to the BBB & was directed to an Iowa BBB website. As suspected, they sent me a letter giving me some crap story about it not being under their jurisdiction or something of the sort...in other words, they weren't going to do anything! That's OK, though...I'm not giving up til GMAC Mortgage goes down! I will post any information I get that may be of interest or help to anyone else. Let's keep our chins up & go get 'em... enough is enough!
