GMAC Mortgage RIPS OFF ANOTHER FAMILY OF THEIR HOME ripoff Waterloo Iowa

This all started when our home was financed through another company that sold to GMAC MORTGAGE. We have always struggled with our house payments (family of 5). We have made the newspaper 4 times within a year on the Foreclosure columns-my husband runs his business out of the house and I am a waitress. Very embarsing to us both. We have struggled to keep the house and got shoved into a REPAYMENT AGREEMENT with a very large lawyers fee tacked onto it. The amount necessary to cure the default is $5354.40 is what they said.

1st payment due on 10/31 of $2000.00
2nd 11/30 of $1405.58
3rd 12/31 of $1405.58
4th 1/31 of $1405.58
5th 2/28 of $1405.58
6th & final 3/31 $1326.35

Now this totals $8948.67, but the amount to cure the default is $5354.40. Where is the $3594.27 going-to the lawyer and late charges. Cuz our normal payments were due on the 1st of the month and they set up the REPAYMENT AGREEMENT on the last day of the month so they could charge us late charges on every month of the REPAYMENT AGREEMENT.

It gets worse! We have just got a foreclosure notice again because after sending that last payment on 3/31 we didn't realize we had to have the 4/1 payment of $1287.27. They knew this was going to happen and wanted it to. They just want our home.

WHY CAN'T WE ALL GET TOGETHER AND SUE THIS COMPANY?

This company needs to be brought down and we can do this with a lawsuit if we all stick together and standup to them.

rhonda if you can get to your online account statements or if they have sent you your end of the yr tax form you should be able to see where the funds went in my case gmac sent me a letter informing me of my request to close my online account this i never did it was their way of blocking info from me

so the best thing to do is send them a letter certified returned receipt ask them for a copy of you account summery for this yr last yr and the one before if necessary also copies of your escrow account if you do this they have to anwser you in a certain number of days 30 or 60 im not sure make sure you keep a copy of this letter to them if they do not sent anything to you or respond you then can report them to HUD RESPA office in washington dc

to joe yep im a little loopy in that responce i have been getting all my files in order again for the hearing thats now moved up to may 3 been at it for two days i had put this behind me for awhile and was refreshing my self oops lol

Hi Rhonda,

Please read my response again very carefully because you will see a way to contact me at Joe's farm. I'd like to speak to you on the telephone so that I can get a clearer understanding of what Gmac is doing to you.

I am not a lawyer, nor do I give legal advice. However, chances are I've already experienced what ever nonsense Gmac is doing to you and I might be able to share with you some useful suggestions.

I haven't kept that good of records. How can I get from GMAC a print out of what they says has happened and where they are putting what money. I started to go to their website so I could look at my records there but am nervous about putting any info in there.
As far as our Repayment Agreement it ended 3/31. We sent each payment Western Union and kept to the agreement until that was paid. It is just that that ended 3/31 and now they are after us because of the 4/1 regular payments again. Didn't know that was going to happen and they are hot on it already-just the 12th.
Virgina in TN how long do they have to give you before they can foreclose on us.
I want all our papers from them to take to someone who can help us find all the wrong they are doing. Is there a limit to how much a lawyer can charge in TN for doing what ever he did in this Foreclosure Repayment Agreement deal.
Should I go to their website to see how much of my account information I can get off there?
What about the option of trying to take the loan to another company a honest one. Is there much chance of that with the credit the way it is over this house.
Virgina how quick can they start forclosing? How many days late until they can legaly move in.

Hello Rhonda,

Sorry to see you are also being victimized by Gmac. I suggest that you contact the legal aide society or bar association in your community. You might be able to obtain inexpensive or free legal assistance based on your income level.


If you can afford to keep the house but need time to reorganize your finances file a Chapter 13 Bankruptcy. Doing so will afforded you the protection of the bankruptcy court. This means that the court will stop all collection efforts by your creditors and give you the opportunity to get back on your feet and repay the creditors over a period of time. This option needs to be taken before Gmac obtains title to your property because once they have ownership you no longer own a house for the court to protect.

I caution you to be very careful about the foreclosure actions taken by Gmac. You live in Tennessee which is a nonjudicial foreclosure state. This means that the mortgage company does not need to go through the court system to obtain title to your property and subsequently the foreclosure process is much quicker.

As to what Gmac has embezzled from your loan payments and is extorting from you in regards to lawyer fees, late charges, and accrued interest; all of that can be addressed by a court. For the moment though concentrate on securing your home from this unethical company.

I am not a lawyer, nor do I give legal advice. Contrary to what Dan and Joe seem to think I am not an expert on bankruptcy or foreclosure/real estate law. However, I'll try to help you and others as much as I can with the limited knowledge that I have.

First of all Dan, I know where you stand but your reply makes no sense at all sorry Dan but please read what you wrote!
Rhonda, I would hope you would try to find Virginia (as Dan spoke about) and myself. Virginia and I talk nearly every day trying to fight GMAC to the end.

The best way I can tell you to reach us is through me, but you have to be smart enough to read between the lines! Are you ready?
My farm is called platoridge doing a google search should find me, if not; I'm in the .com community.
I'm also dealing with the Waterloo Iowa office and have been doing so since 2002. Due to a stupid lawyer that turned in no evidence on my behalf, I lost in foreclosure court. By the way that lawyer spent two years on my case and never billed me a single penny! Who was paying my lawyer?

I'm currently in Bankruptcy court PRO-SE just to save my home. Like myself you have the evidence, now it just needs to be brought to the courts attention; This is going to be hard to accomplish.

We are looking for that group to take down GMAC, are you in it for everything? OR are you looking to settle ASAP just to save your home?

To everyone out there; I think I found that lawyer to help us, but no guarantee at this point!

first off you say they have set up a repayment plan i hope you have all the docs of this with sighned copies????? if you do they cant foreclose on you unless you havent stuck to the repayment plan

now and we have all said this before you MUST KEEP ACCURATE RECORDS i say this because im going to trial here soon and from what i have seen from gmac they do not keep the right records or information their attorney has sent me so much crap with the wrong dates on it i laugh all the time its like they pull this out of a magic hat

so this is what you do keep all the dates times and names of people and depts that you talk to at this piont you should be only talking to a person in their loss midigation dept no one else and always ask for the same person now you need to go to the clerk of the court in your city and ask if you can file a counterclaim against them try reaching virginia on here shes an exspert on this

file a counter claim this puts the scare in to them or find and attorny try leagel aid for a referal keep us posted
