Notice to all being ripped off by GMAC Mortgage Corporation, no matter what city you pay to. Including Daniel down in Florida!

I've made a few posts, but never have given exact details of my case, due to the fact that I've seen that GMAC has been watching this website, and are taking notes, so please watch what you say here so GMAC cannot be prepared in court against you, knowing your arguments.

I almost lost my home due to my lawyer on July 12, 2005. But because I demanded my lawyer to argue the case, it was extended to August 15, 2005. (My lawyer wanted to "continue" for the sixth time!

Each of you needs a lawyer that is RESPA & FDCPA qualified. But, if your like me you will not find any lawyers near you that are qualified in those fields. Trust me, you need to be qualified in those fields!

I took it upon myself to hire a lawyer that will buy me the time so I was qualified in those fields and I hoped I could train him in a field that is wide open for new business. Trust me, effective August 15, 2005, in the middle of court my lawyer will be fired! Much like I'm sure your lawyer is, mine is only in it for the short term money, instead of thinking about what GMAC is doing to millions of families.

As I said before, my lawyer will be fired on August 15, 2005 in the middle of court and I will represent myself. If you all will do a search on Google, looking for "RESPA" the first website should be "HUD'S" do most of your searching there! READ EVERYTHING! There are ways to question your mortgage company and get paid $1000.00 if they do not CORRECTLY answer within 60-days!

Still trying to hide everything from GMAC, if you can prove to me that you are not part of GMAC's-Rip-Off-Team (GROT), I will be glad to inform you of what I will tell the judge on August 15, 2005. Once again, I have an email address of gmac, my farm is named platoridge, and I like the .com ending! If you can add those together, you know how to get in touch with me! And if you use www. in front of my farm's name, you will also find my website!

I pray for you all dealing with GMAC that you will prevail in court. There should be no mortgage company in the world that can do to you what GMAC has done to my family. There's only one way to get rid of GMAC for good, CONTINUE YELLING on this website, then do your own investigations on your loan, and FIGHT for your rights!

I only ask one thing in return for the information I've given and will give, please pray for my and my family! We have four ponies, nine goats, four rabbits, 24 chickens, two dogs, nine cats (darn tom-cats) and three children. None of which can live in town, if I do lose in court, I will provide the best I can for my family of wife, children and animals. But please help me put a stop to GMAC's rip-off tactics!

The judge's decision came back today, as of right now we have 6 month's to be out of our house.

My lawyer is filling for an appeal early next week, and I asked him tonight to ask for a jury trial. With a jury trial (the way I see it) he can put me on the stand and question me for all the numbers now lodged in my head and put them on a "Overhead Projector." As he said "What good will this do?" I told him "If I can get a jury trial and 10-12 people see my numbers in front of their face what is going to happen?" His only comment was "You will win the case!" He his now going to check his law books to see if this is possible at this point. And he is planning to call me sometime tomorrow to tell me if this is possible.

On the other hand, this coming Monday or Tuesday my lawyer is going to file an appeal for the judge to reconsider the facts. I need to get my lawyer as much information as possible between now and then to file the appeal. Some of you sent me your information that my lawyer said was "a goldmine" some of you said you cannot send me information due to your current case, but some of you promised to send it, but I never received it!

I'm in this for the long run, even if I lose my farm, I will fight for all to help out in any way I can! GMAC is not going to lose this war, they have to be stopped NOW! Please send me your affidavits, and I will do the same in return!

Because I started a website to beat GMAC, I'm also putting this letter on the internet where most of us met each other.

So for those of you that are trying to find a way to beat GMAC because you are getting screwed by GMAC like the hundred's of us that have been dealing with GMAC for several years, I can be contacted if you can read between the lines!

Another Delay in Court

Court was once again today at 1:30, that came and went with neither lawyer (mine nor theirs) 2PM same story, no lawyers. 2:10PM I was called to the judges bench, then released because according to the judge I should not have to sit around and waste my time waiting on the lawyers.
As I was exiting the court house I was shocked to see Mrs. (((ROR REDACTED FULL NAME FOR SECURITY PURPOSES))) (GMAC's Lawyer) walking up the steps to the court house. I returned to the court room and the judge gave the look like "why are you back here?" So I explained to him Mrs. --- finally arrived.

Once again I was called to the bench, this time to be told that my lawyer is no longer going to be praticing law!!!!!!!!!! I have until August 23rd 2006 to either get my lawyer back into court, or find a new lawyer!!!!!!!!

I'm kinda thinking that I should go pro-se since this is my second lawyer I went through on this case (the first one was appointed judge.) So any one that pratice's law, I would appreciate some helpful feedback. If you're a lawyer, I'll be glad to send you all the information that I have if this will help you help me.

The attorney that you will be sitting down and resigning the paperwork represents the bank...that's just the way it goes. The attorney that refinances your house and has you sign the final paperwork always represents the bank before the client. That's why they get the money. I wouldn't suggest getting rid of him/her at all. Instead get a second attorney to witness at the closing. He/She will have your best interests in mind and can not be swayed by GMAC. By having a second attorney, not only is the bank protected but you will be as well. Keep in mind that this will be probably twice as long as a normal closing because more parties will be looking into the paperwork and reading it through, but its the only way to protect yourself from getting screwed again. You should also have GMAC issue a letter of deletion for the previous mortgage for both you and your wife so that nasty foreclosure is taken off your credit report. Make sure that the letter has the exact account number and information as reported on the credit report and have a second one drafted up with the actual information and information that you have on record. It needs to be put both ways because credit reports have variations on account numbers and they generally don't match up with the actual account numbers. This needs to be sent to equifax, experian, and transunion so that all three major bureaus will update and remove that account and all history of it. What this does for you- it removes any and all lates that do not apply to you as well as the notice of default or what ever it says and helps repair your credit and higher your score.

The mortgage is the only thing credit related, therefore if the house is foreclosed upon with you as sole holder of the mortgage, only you should be affected. She had nothing to do with the mortgage-so why did they report that. What I would suggest, dump your attorney and contact the Department of Banking for your state, especially direct towards the Banking Commissioner. Explain the situation, he/she may ask for a copy of the original closing package that you got when you got the mortgage as well as the documents you were provided with during the law suit so have them handy. They should be able to direct you to a attorney of theirs that specializes in this area. If you need help doing this, feel free to contact me and I'll contact my state's banking commisioner and he'll be able to help. You will especially need a copy of the note-it tells the terms of the mortgage as well as who holding the loan and who is being lent the money. Make copys of all those documents-never give the originals- and be prepared to hand them over to the banking commisioner. They are the ones that make sure these companies are in compliance with RESPA laws and will be able to help you to clear this up. I hope this will help you.

A Question to all with knowledge

Even though my attorney is getting paper work ready for me to resign with GMAC (yes my second mistake) So I am in search for a Lawyer that is willing to fight for me! Call me if your out there!
BUT MY QUESTION IS:
GMAC's default division still continues to call and badger us 2-3 times per week "Wanting to know what our plans were with the house!" Last week my wife was finally home to answer the phone instead of me, but GMAC refused to talk to her! They said she was not on the loan nor was she listed as a contact to deal with the loan. I thought this was the case the whole time, (I thought her credit was so poor at the time of the original loan, the only way to be able to get the loan)but my lawyer said that it was not the case.
If for fact this is the case, that my wife is not on the loan, she cannot even discuss the loan, then how can her credit report be ruined by a illegal forclosure? My lawyer said that it can because her name is on the Deed, but if its not on the loan?????
Please let me know!

Last week I called my lawyer asking where the paper work for my lawsuit against GMAC was (that he was to file 1 1/2 month's ago!) He told me that he's been busy but he would get it sent to me to sign prior to court. I never did get that paperwork! (Imagine that!) But instead I receive a check from GMAC in the amount of $1979.46, which just by chance is the EXACT same amount that I put down at closing for FHA insurance. Called my lawyer, he didn't know about it. (Imagine That!) He called GMAC's lawyer, she didn't know about it either! (Imagine that!) But I can cash the check because it was not a "settlement."
Now I get thinking that GMAC has not called for a week or so (They usually call every three-days to see what my intensions are for my home, or they say "This is so & so from GMAC Mortgage, I was just calling to see how things are going out there at your house?" (Yep you ask stupid question, you get stupid answer)So I started saying stuff like "Oh pretty good, mowed the yard for about 5 hours today (15 acres) me and my wife are planting flowers and pulling weeds in our flower bed, but if you have nothing better to do than call me to see how my life is going, come on over, I need weeds pulled in my garden! For some reason, I hear a dial tone after that!
To my surprise prior to our case opening today in front of the judge, my lawyer came up to me, shook my hand and said congratulations, you won! "GMAC is going to give you a fresh loan so you can start from scratch, if you pay them for a little while and get your credit score up, then you can refinance with another company." (probably to have it sold back to GMAC)(Sorry Daniel, had to throw that one in there!)
I said, what about my counter-suit? Lawyer said "Forget that, you won! There is no way your gonna get out of this without paying for the house and dealing with GMAC!"
HE HE HE, I don't think so! I will look at the new contract that is suppose to be ready in 60-days, knowing they will be ripping me off in that contract as well. It takes GMAC 60-days to write a new contract????
I'm now looking for a new lawyer that knows what he is talking about and will not hide behind the judge's bench to not be seen nor heard. If you can (and WILL) FIGHT in Iroquois County, Illinois call me and I will interview you!
To everyone else dealing with GMAC's crap;
You owe it to yourself to spend every waking moment, to prove you are right and GMAC (or any other company) is wrong! Stand up for your rights and fight for those right's. I am only one with only a high school diploma, but GMAC is giving up on me, just like they can with you!
My fight is far from over, GMAC has turned my family's life upside down since February 2002, has made my credit report so bad it should be rated "XXX." They made me lose 5 rental homes, (income totaling over $1500.00 per month) due to they're outragous payment requirements, almost made me lose my truck,and has turned me into an alcoholic.
GMAC employee's;
I know you are reading this, my fight is far from over. I know you are reading this, because if you wasn't you would not of gave up in court today! I would just like to know how much you get paid to ruin other people's lives? Obviosly you are getting paid rather well. Put yourself's in the shoes of people you are trying to ruin to make a profit, then try and get a good night's sleep!

Court was once again delayed!

September 12, 2005 I went to the court house prepared, file folders full of information showing I was never behind when this foreclosure case started.
Mrs. Peeks (GMAC's lawyer) was going to ask to file a 60-day extention because "GMAC is such a large company, they won't even listen to their own lawyer!" In other words she knows I'm right and wants time to convince GMAC that I'm right before they lose their butt in court.
Come to find out the Judge was in a jury trial and only had enough time to continue the 3-4 cases that day anyway. So court was continued until November 16, 2005.
But because GMAC won't listen to their own lawyer I decided to open GMAC's eyes a little. Next week my lawyer will have the paperwork ready for me to sign. This paperwork is a counter-suit to GMAC's foreclosure case to the tune of 2.5 million dollars. Do you think they will start opening their eyes and listening now?
I'll give more details as they come in.

Sorry to all, not wanting to keep you waiting. My mother-in-law passed away 8-11-05 with the services being same day as court, it will be continued to another day. I'll place an update when I know more.
