Around June of 2000, Me and my wife recieved a call from Gold's Gym, in Independence Missouri. They are owned by Wade Ferguson in Mission Kansas. They said we won a free membership to there gym. We decided on day after the call to go in a see about it. They tried to sell us a membership but we declined it. They said ok, and said that we can have our free membership but was being way to pushy.
We left and never signed anything. We never showed up there again. We also never heard from them again. Well, this year, 2004, we applied for a copy of our credit report and found that Gold's Gym had us down for oweing aprox. $1500.00!!!! We called there gym and found out the location in Independece MO had closed down, but did get the owner company's name, Wade Ferguson. We called them and they said it was for 2 year membership and they stated that I signed a contract. I NEVER signed anything ever! They refused to send me a copy so I contacted the better business bureo and file complant. They got the same reply I got, that they had a signed contract.
I have rebutted they responce but have yet to here a reply again. I have never signed anything and they are either lying or someone fordged it! But, they refuse to remove it from my credit report. I just thought someone might of had the same crap pulled with them that could help me, or someone might have some ideas on what steps I should pursue next. I also thought I should WARN everyone to watch out for a call for Golds Gym stating they won a membership.... They are tring to pull a slick one on you.... I suggest taking your business else where!!!! They are crooked and plain out criminals!!!! Thieves and lyers! I would let myself get fat or out of shape before I'd do any business with them crooked outlaws! Stay away from them people!

It is instructive that anything was able to make it into the credit report of this person who did not sign any contract, in that credit reports are generally only accessed through the expedient of a social security number. How is it that you provided a social security number to these folks and neglected to sign a document? It strikes me a necessary that information like this would be protected in the event that no contractual arrangement was to be agreed-upon.
For others to learn from this, do not offer information or sign/write anything unless you are committed to executing the contract, there's no harm in saying 'no' at any stage of negotiations, and never ever be frightened of retrieving forms/documents that you do not wish to have retained by personnel, there's no legal standing for them to retain such except through hubris.
