I worked with these people for a year and half. They ruined my life. Single mom; lost my job looking for new work. Same scam as everyone else. Saw an ad, answered an ad; had a job by days end. I was recently split from my fiance and needing income pretty badly was ecstatic at the success I had in finding a job so quickly. I have a daughter to support, no family within helping distance and a need to keep a roof over my head. Went through training with no sales; I had no friends or family to go "sell" to in the area. I set up 6 bogus appts to keep the trainer at bay. I didnt want to lose my job; I still had no real idea what the hell I was doing even after day 3 of training. At this point all I had learned was how to take this thing out of and put it back into a box. And to be quite honest I wasnt very good at that. All I was worried about was how to not lose this job so I could take care of my responsibilites.


After training weekend I went out on the "VAn" was told to follow one of the kids to learn what the hell they do. It was incredulous; these kids went up to peoples house and tried to beg and plead their way into someone's home and sell them a 2000 vaccuum cleaner. Dont get me wrong good product but ummm seriously. Well my manager was good. He kept us entertained, I actually witnessed the scheme work and thought well 475 for 15 appts. Its something, right?


I was actually paid my 475 and stayed on to learn that I could not really sell one of these things but I could be the best begger and pleader at someone's front door. (Sorry to any of you reading that was subjected to me) As a female I was less intimidating to those who actually looked before answering the door and my manger taught me how to set up appts. Which meant walking from 12pm to 10 pm in dangerous neighborhoods by myself in rain, snow, heat you name it we worked. When I got frostbite on my legs from waiting for the van for 2 hrs in the freezing night I was told true champions survive. Get out there, stay positive, you can do it girl I know you can. I had a daughter and I was sacrificing every day to be out there and just make enough money to support her. They knew this and knew how to manipulate the situation so I didnt leave. Eventually working the hours I was, caused me to lose everything including my apt(landlord evicted me after I helped a fellow Kirby employee stay with me and my lease didnt allow it) my car and my daughter.


Thanks Kirby for the free trip to Mexico, Lake George, and New York the Pro clubs were great; SOME of the people were too. (But can I get that time back to be with my daughter PLEASE) For the most part everyone is right, you distibutors are greedy and have no real Sales ethics. Kirby is a great product and with a well run distribution co. behind them could probably make there way out of so many peoples negative views. I do believe in the product and some of the nicest people I have met work there and I pity them for being continuosly duped by a coniving, decietful, lewd jerk.

I took a couple days of training and decided not to pursue working for the distributor.

I have some tax and business experience and have discovered that their contract withe the dealers is illegal. Both at the state and federal level there is a legal defintion of an employee and an independent contractor. The contract that dealers sign with the distributor is so restrictive that under the law the dealers are defined as employees.

That means that the distributor must withhold federal and state income tax (if your state has income tax. The distributor must also pay their share of medicare and social security tax and federal state unemployment tax.

You should file a complaint with your state department of labor and department of revenue.

If you are classified as an employee the company owes you the minimum wage for the hours you worked or at least 40 hours a week.

If you have filed a tax return as independent contractor you should go the website www.IRS.gov and download form SS-8, fill it in and send it to the IRS.

If you signed a dealer agreement with the distributor you should bring it to a lawyer who specializes in employment issues.
