I was in a modification plan with Bank of America. I made every payment on time. They never finalized the modification (after over a year of my making payments). They then sold my mortgage to Green Tree who immediately demanded all of the money I had paid to Bank of America that had been held in unapplied funds. It was never credited to my mortgage so I supposedly owed about $14,000. Anyway, in foreclosure, I managed to get the money from my father and pay off the entire amount (by then, $17,960).  Green Tree's lawyer had sent a letter stating, "Pursuant to O.C.G.A. 13-1-11, you are hereby notified that you have ten days from the receipt of this notice withinwhich you may pay the principle balance without incurring any liability for the payment of attorney's fees."  I paid the entire amount within eight days and sent them proof to this effect.  They said I had to pay it anyway or be placed back into foreclosure. I am now again in foreclosure and they just sent me a bill for $20, 126.07.

This is fraudulent. I owe absolutely nothing .  This is an attempt to extort me. They kept the check for $17,960 I sent to their bank, Bank of America (coincidence?).  They will not return my phone calls and when I attempt to access my account information on the Green Tree website, it is blank. It says contact your representative. There is no way to do this . All of my phone calls are automatically routed to a voicemail that never responds. These people are crooks. They see the equity I have in my home and have done every illegal, misleading, coniving and unscrupulous act that they could think of to get it. Who would buy a mortgage that was reportedly behind. $14,000 unless they wanted to reposses it?  But I digress.  I am 100% current on my mortgage but I suspect they are not applying my payments to the mortgage until I pay the attorney's fees that I do not owe!  How can this blackmail be legal? Georgia is a non judicial state so the mortgage companies make up their own rules and laws as they see fit and profitable.  Please help me.   Paul, Atlanta, Georgia.

Hi,

 

My name is Sarah, I work for a company that deals with these types of situations. Green Tree is one of the names that has been coming up a whole for the past few weeks.

 

It seems they are going around and buying up a ton of fraudulent loans. We have had over a dozen clients recently who now have Green Tree as their lenders.

 

Since this has only been a recent event we might be able to help you keeping them from forclosing on your properties. Along with the other services we offer we have a packet for a Stay of Excution to stop forclosures. Personally I know at least two of our clients have used it and stopped forclosure long enough for us to finish their investagations and prove the fraud.
