On September 12, 2005. My Husband and I decided that $450+ homeowners insurance a year was terrible, so we asked around.

We found AAA to be a great deal, and we saved $200+ a year by switching to them from the American Bankers Company that is with Green Tree Servicing/ Conceco.

We signed a Legal Insurance cancelation document, witnessed by our new AAA agent and signed, as well as my signature, also dated for September 12, 2005.

We have been charged NSF fee's due to the submitting their mortgage price plus Homeowners insurance (when we had canceled over a month earlier.)

My husband then made a payment on the phone Person to person for our House payment, minus the homeowners cost.
He did the transaction for 322.65 vs our house payment of 327.65. We thought was odd, but thought maybe that was their way of saying, Sorry We'll nock off 5 dollars for you.

However 2 days after making a person to person payment.
they resubmitted their fee+ mortgage payment. Causing our Bank to do NSF charges again, then they charged a Phone payment fee of $7.00. Causing another NSF fee.

We at this time are owed our Homeowners for the month of Sept and the Fee's for October. However they denied us twice. Saying they will not pay our NSF and our money for Sept 05.

We contacted the WA state insurance commissoner. Who informed us that double homeowner insurance is illegal. that our Document states that we canceled on Sept 12, 2005.

Green tree States that The date signed on the Cancelation form, means nothing it's the date recieved and processed that matters.

However Law supercedes policy.

We now have the WA state insurance commissoner's office working on the case for us. If they dont comply with them, then We will be seeing GTservicing in Court.

Basically Dont mess with us. :-) We dont take crap. We fight back for what we are owed. Green Tree we won't give up.

They have noted on our conversation that a wrong FAX number was giving to my husband. Along with the guy who took our payment person to person on the phone did the Wrong amount. and didnt cancel the automatic payment. (which caused our NSF funds)

So they know they are at fault.

Yes, We signed and had witnessed a document of cancelation. It sits before me as we speak. We also switched our Car insurance, and have already recieved our cancelation retro back to signed date. And recieved our money from them.

Green tree is saying, that they never recieved it or anything untill Oct 6th. However My husband called on Sept 27th to make sure it was recieved and they said no, and then he asked for the fax number.

the Guy who gave him the fax number then found he gavet he wrong number to my husband.

So again the paper work was faxed. However to the incorrect fax number.
This is noted in our conversations recorded with them.
They mentioned yes we did give your husband the wrong fax number that is why we are going back to Sept 27 when your husband called.

However, by WA state law it doesnt matter from the time they recieved, it matters by date signed.
We signed 9-12-05. Witnessed by AAA, and sent off.

Its now in the WA state commisioners hands, we filed a complaint and they have till Nov 29th to respond, and comply.

We have since also refinanced with a much b etter company, who has better rates, and service.

This is common, did your new insurance company ever send over a copy of your new home owners insurance to the mortgage company?

If they didn't then the mortgage company has every right to protect their interest in the house.

IF your new company sent over a copy of the DEC and has proof of that, submit it (make copies) via certified letter.
