Greentree Financial Took pymt, never credited it and repossessed mobile home Jacksonville Florida
I had my mobile home for 10 yrs and had a few times I would get behind but always get it caught up. The past two years has been pure hell with Greentree/Conseco. They tacked on homeowners during hurricane season causing my morg to jump from 456.73 to over 670.00. I finally get a homeowners policy wrote and they still kept charging me more then what I was suppose to pay.
I had filed a chapter 13 but after giving it careful consideration decided to have it dismissed and try to get all my bills caught up on my own and greentree had agreed to work with me. I send them in 4 pymts all to be paid one wk apart. They cash one ck, send me foreclosure letter, a letter of replevin and said they sent it by a courier and I never got them nor did i sign for them.
To make a long story short I am sitting in my home on a fri after having minor surgery on my foot and get a knock on my door for me to vacate the home within 30 min. Wow, what a total shock, all my animals, a sick mom staying with me, and being sick as well I can't begin to tell you my head was spinning. I got everything I could get together including my inside animals and went to attorneys office, he told me to go home and take a load off that they couldn't do this.
Well, I go home and there is a letter on my door telling me they will be back mon to get the trailer, oh and the letter also stated we took your centeral heat and ac unit, how dirty, bad enough they were taking the home but the ac for the weekend I guess they wanted to make life pure hell for us. Husb has chronic asthma, I have it as well and my mom has congestive heart failure.
Anyway long story short. They got the home, I was in the mobile home the day they told me to get out, it was a double wide I was trying to get my special need cats out of the home because I run a fairly large feral cat rescue with a few that had to be left inside. I yelled at the guy to give me time to get my handicapped cat and he ignored me and starting moving one side of the dble wide while I was inside causing me to fall between the cracks,
okay they finally get the home off the property and I have totally lost it cause i knew there were still cats and a few kittens inside the home, they told me the cats would jump out while the home was being moved down the road, yeah right! I get a letter telling me I had 15 days to get all my stuff out of the home or I would lose it. I got everything I could but still lost allot including lives of several cats. I managed to find one cat that had been stranded under the mobile home for 10 days no food and very little water it is a miracle my girl survived.
I could go on and on with all they have done and continue to do but I would bore everyone I'm sure. I want to know if we can get a class action suit brought against these cold hearted crooks and put a stop to them once and for all!! oh by the way I was only 2 pymts behind but they said I owed two pymts on homeowners, late charges, and legal fees which totaled right at 5,000 and I had paid on the trailer for over 10 yrs and bought it for 45,000 and was quoted a pay off before they took it over 52,000, and now I get a letter yesterday giving me 10 days to pay them 35,000 the bal of what I owe after they sold the home for 18,000. come on who are they fooling the home was not worth but maybe 7,000 it had allot of wear and tare it was made cheap, cheap, cheap.

And don't deal with the people in jax they are the meanest, rudeist people you will ever talk to. Sorry about the spelling, Good Luck all of you that has to deal with these people. The only good outcome of all this is that we had a single wide donated to us and it is a fixer up but no pymts.

If any of this is true the first thing you need to do is find a better lawyer. A good lawyer would've advised you to call the police if the repo men came back. They were almost certainly breaking the law. A mobile home doesn't have the same protections as a conventional house but I would think that some sort of court action still needs to be done before the owner can be evicted and it repo'd. If the police would've been on their side, they would've arrived with them.
You can now sue their ___ off for personal injury from moving the house while you were inside and causing you to fall. Ordinarily, suing for personal injury when you're not really injured is a very bad thing to do. But these are not ordinary circumstances.
