Earlier today, about 5 p.m.(EST), I got a phonecall from H&P Capital. When I answered the phone, the man I was speaking with verified my identity, by using part of my SSN, then proceeded to tell me about a debt I have with CashNetUSA for a payday loan I have not repaid.

The man then told me that he did a background check on me and found that this was the first offense I had like this, so we could work this debt out voluntarily, because if not settled this evening, papers would be filed in my county this evening or tomorrow morning, and they would have the police come to my house or my job tomorrow.

I explained to the man that it snowed here at my house today, and that I would do a MoneyGram, but not today because of the snow, he then told me it had to be by noon tomorrow or they would proceed with filing papers.

I have since researched this company, and found MANY people that have recieved similar phone calls from this company. I do not believe you can be arrested for not paying a bill, if you could then half the country would be in jail. I have also read(though I have not verified it for myself yet) that this company is under investigation by the FTC and FCC.

I have decided not to pay this bill through this company, they seem to be running some sort of scam. I have found that they were licensed in FL on 12/05/05/2008, but I have not found that they are licensed to conduct business in Maryland, which is where I live and work, so I believe them to be in violation by even calling me here.
