Hi I understand that you are trying to help people and i have been there i tried for 2 years and after 3 denials i got a loan modification I was referred to a guy named P.J. Stuart at the advocacy group at 818-392-3603 and he found me an attorney that saved my home so you see not everything is doom and gloom you just have to use your head america is still the best country and we are d**n lucky to be here god bless america

I waited 3 months for a loan modification approval from bank of America,my mortgage was 4 months behind and the house was in foreclosure process and there was an auction date on the house for April 5TH
after waiting without an answer from our mortgage bank and 5 days before the auction we decided to call hope for help they were able to get a loan modification for us(or we thought)
the day before the auction date(April 5Th) a negotiator from bank of America called me and ask me to send $1600 dollars ONLY FOR THE PURPOSE OF STOPPING the auction on the house .he asked me to send the money that same day by western union via quick collect and that he would check later on that day or the day after in the morning to see if the money was there.we had a real hard time putting the money together and with a lot of effort we finally did and immediately send the money.then by April 9Th somebody from Fannie Mae was trying to put a lock on the door(they couldn't because we were at the house) we immediately called bank of America and they told us that the money was supposed to get there on the 5Th no later than 3:00 pm and that's why the house was sold to Fannie Mae(this guy never mention to send it before an specific hour.)after several attempts to talk directly with him I finally got to talk to him and he ask to send a copy of the western union receipt to a fax number he gave me and he said he was going to start a process of RESENDING which means buying the house back from Fannie Mae. it's been a month and a half and every time we called we cant never EVER talk to this guy and we talk to at least 30 negotiators in the past month,they all tell us the same thing "it's in resending process, and that's all they know (no body knows anything)we can send him an emergency e-mail asking him to call you" in the mean time we keep receiving letters from Fannie Mae lawyers asking us to reply before may 13 by going to court we called bank of America so we could get proof that they were working in the resending process so we could take to court. that day we contact the attorneys that are working on the eviction to ask if they have received any notice on this case from bank of America and they said no but they  got in touch with Fannie Mae to find out of any notices from bank of America regarding our house and for our surprise Fannie Mae told them that they are not working on any resending of this property with bank of America.we called Bank of America to confront them about what we find out and they admitted that they could see in the system that in deed the property was not in resending.it never was. we were shocked!!!!!we never felt so violated,abused,betrayed,cheated,ignored,insulted,intimidated,manipulated,neglected,threatened,tricked,
unheard,used,victimized,lonely and thats only a few of he words that we can dscribe how we feel now.
 we call them back & told them what we find out about Fannie Mae and they actually admited
we know that Bank of America has hindering this case for the intent to foreclose our house.bank of America it's been misleading us with false and wrong information from the begining of our loan modification request.now we are been evicted from our home

THE TRUE STORY, THE BANKS DON'T WANT YOU TO KNOW HOW MUCH MONEY THEY MAKE BY TAKING YOUR HOME, GET READY FOR YOUR OWN FORECLOSURE, IT'S JUST A MATTER OF TIME!

Why Loan Modification and Short Sales are a Suckers Game

 

Assuming you have MERS on your mortgage (and everything in the following is,  indeed,  based upon that assumption)  loan modification and short sales are a suckers game designed to lure you into a false hope and squeeze you for every last dime the banks can get out of you. 

Heres why.

 

First and primarily, you are negotiating with your servicing entity, not the true owner of the note.  As such, the person you are talking to has no authority to do anything.  They cant do anything without permission from the note holder.  And who is the note holder?  No one knows and that is the entire basis upon foreclosure defense.

 

But thats not all.  If the servicing agency tries to pull certain notes out of a securitized trust for modification, he must buy those individual notes outright at the value the trust would have seen for that note had it held to maturity.  No one wants to do that.  As evidence,  Countrywide settled a suit from several state Attorneys General to modify the terms of what the attorneys general had called predatory loans.  No sooner had Countrywide entered into that agreement than they were served with a multi-billion dollar class action lawsuit from the bondholders demanding Countrywide buy the notes under question at full value before re-negotiating any terms.

 

Next, you need to understand there is big money in foreclosures and short sales.  One of the metrics of a banks health is the number of performing loans.  If a bank forecloses on a home or submits to a short sale, they remove a non-performing loan from their books.  Further to that,  Fannie & Freddie have cut a deal with the banks where they will receive 90% of the face value in the event of a foreclosure and 70% of face value in the event of a short sale.  So if a home is foreclosed upon, the bank collects upon the insurance on the default through the SIV (Structured Investment Vehicle) as well as 90% of the face value from Fannie & Freddie.  They are paid twice.  In addition, they own a hard asset (your home) which counts towards the banks overall health.  In the event of a short sale, they get the money from the short sale (performing note),  70% of the face value of the old note (it has nothing to do with the real value),  plus,  unless you are real careful,  they can come after you for the shortage.  Paid Thrice.   And in both cases, they get clear title, which is what they currently lack, and what makes challenging a foreclosure successful.

 

And lets not forget the money these sales generate for  title companies,  real estate agents (in the event of a short sale),  foreclosure mills,  mortgage bottom feeders like PennyMac a company formed by former Countrywide execs to take advantage of the collapsing mortgage market,  and appraisers.

 

If you are a homeowner you need to check title on your deed.  You can do this by a quick trip to the recorders office at your county courthouse.  Do not bother with your title company.  What they have will most likely mirror what you will see at the courthouse,  but not necessarily.  The only information which matters is what is at the courthouse.  If you see MERS on your title,  or verbiage like CWALT Inc Alternative Loan Trust 2005-28C3 Mortgage Pass Through Certificates, then there is a high probability your mortgage has been securitized and as such there is a real chance that in addition to no one being able to foreclose,  no one is able to deliver clear title.

 

If you are in foreclosure, or fighting a rear guard action to forestall foreclosure, do NOT pin your hopes on loan modification or a short sale.  Save your money, save your heartache.  Do not bleed your savings to keep paying your mortgage.  Play the game so the people on the other side of the phone are happy,  but know going into it that the whole purpose is to make you feel good as they bleed you for a few more months and then foreclose anyway.  Dont play.  Instead go to www.hangtownfilms.com or call Mike Williams @ 530-306-8203 and let him guide you through this process.

 

Short sales, loan modifications and even deed in lieu of foreclosure are the way the herd is trained to operate.  The herd will pressure to do what the herd does because that is what the herd does.  But always remember if you follow the herd, they are quite liable to run you over the cliff.
